On Wednesday, May 20, the Supreme Court granted certiorari in Free Enterprise Fund v. Public Company Accounting Oversight Board. In this special cert grant episode of SCOTUScast, we take a look ahead to this important case that the Supreme Court will hear during its October 2009 Term. In this case, the Supreme Court will consider whether the Sarbanes-Oxley Act of 2002 unconstitutionally violated the separation of powers or the appointments clause by granting the Public Company Accounting Oversight Board far-reaching executive power and having its members appointed by the Securities and Exchange Commission and removable only for cause. Northwestern University Law Professor and Federalist Society co-founder Steven Calabresi discusses the case.
