In the 2005 case of Gonzales v. Raich, the Supreme Court controversially ruled that Congress can regulate plants growing in someone's backyard for that person's personal use. The Constitution's Supremacy Clause says that when state law conflicts with federal law, federal law prevails. So given that the federal Controlled Substances Act bans marijuana possession for any and all purposes, how is it that nearly half the states allow medicinal marijuana, or have legalized recreational marijuana? Is the Obama administration abdicating its duty to enforce the law by not cracking down on these recalcitrant states? Here to tell the somewhat counterintuitive tale of "marijuana federalism" is Ilya Shapiro of the Cato Institute.
