On March 19, 2012 the Supreme Court heard oral argument in Astrue v. Capato. The question in this case is whether twins who were conceived in vitro after the death of their biological father, and who cannot inherit the father’s personal personal property under state law, are nevertheless eligible for Social Security child survivor benefits.
