Maureen K. Ohlhausen

Biography

Maureen Ohlhausen is a partner in the Washington, D.C., office of Wilson Sonsini Goodrich & Rosati, where she advises industry-leading clients on complex antitrust and litigation matters, with a focus on high-profile cases. Sought after for her depth of experience on antitrust and Federal Trade Commission (FTC)-related issues, Maureen is known for her relationships with officials in the U.S. and abroad.

After finishing law school and clerking at the U.S. Court of Appeals for the D.C. Circuit, Maureen joined the FTC in 1997. She held a series of roles at the agency over the next 12 years, rising to the position of Director of the FTC Office of Policy Planning, where she led the agency’s work on e-commerce and headed the FTC’s Internet Access Task Force, which produced an influential report analyzing competition and consumer protection legal issues in the broadband and internet sectors. She then went into private practice at a leading telecommunications law firm, where she headed the FTC practice group.

In 2012, Maureen was confirmed by the Senate as a Commissioner of the FTC and was appointed Acting Chairman in January 2017, a role she held until May 2018. As Acting Chairman, Maureen directed all aspects of the agency’s antitrust work, including merger review, conduct enforcement, and all consumer protection enforcement, with an emphasis on privacy and technology issues. Under her leadership, the FTC won several influential merger challenges in court and reached a number of key digital privacy settlements.

To date, Maureen is the only FTC Commissioner to have received the Robert Pitofsky Lifetime Achievement Award in recognition of her contributions to the FTC.

Following the end of her term at the FTC, and immediately prior to joining Wilson Sonsini, Maureen was chair of the global antitrust and competition practice at Baker Botts, based in that firm’s Washington, D.C., office.

A recognized thought leader, Maureen is a frequent author and speaker, and is often quoted by leading print and broadcast media on antitrust, FTC, and privacy and data security matters. She has published dozens of articles on antitrust, privacy, intellectual property, regulation, FTC litigation, telecommunications, and international law issues in prestigious publications. During her tenure at the FTC and in private practice, she testified more than two dozen times before Congress, including before the Senate Commerce Committee and the House Energy and Commerce Antitrust Sub-Committee. She also testified before the Antitrust Modernization Commission.

John S. Baker

Dr. John Baker is Professor Emeritus of Law, and previously the Dale E. Bennett Professor of Law, at Louisiana State University Law School. He is currently Visiting Professor at Peking University School of Transnational Law (via Zoom) and has been Visiting Professor at The Center for the Constitution, Georgetown Law School (2013-2020). He has also been a Visiting Fellow at Oriel College, the University of Oxford (2012-2014) and taught at Blackfriars Hall, Oxford in 2014. Dr. Baker has also been an adjunct Fellow at the Heritage Foundation (Spring, 2008) and a Distinguished Scholar at the Catholic University of America Law School (2011-12). He has taught at Tulane Law School, George Mason Law School, Pepperdine Law School, New York Law School, Hong Kong University, and the University of Dallas, School of Management and also taught and/or lectured in 17 foreign countries. Notable among his foreign visits are the

following: Visiting Professor at the University of Lyon III (France) (1999-2011); Visiting Professor at the Universidad de los Andes, Chile (2012), as a Fulbright Specialist (2006); and a Fulbright Scholar at various universities in the Philippines. Dr. Baker received his J.D., with honors, from the University of Michigan Law School and his B.A., magna cum laude, from the University of Dallas. He also earned a Ph.D. in Political Thought from the University of London. Baker has taught over a dozen different subjects, mostly courses in public law. His main areas of interest are Constitutional Law (particularly federalism and separation of powers), Criminal Law, Anti-Terrorism Law, International Law, Health Care Law, Mediation, and Comparative Law.

In addition to law review articles and book chapters, Dr. Baker’s academic publications include Hall's Criminal Law: Cases and Materials (with Benson, Force and George; 5th ed. Michie, 1993); An Introduction to the Law of the United States (ed. with Levasseur; University Press of America, 1992). He has also published on Forbes.com, FoxNews.com, in The Washington Times, and a number of times in The Wall Street Journal. He argues in federal court, including two oral arguments in the U.S. Supreme Court. For many years, he co-taught courses for the Federalist Society on separation of powers with the late Supreme Court Justice Antonin Scalia. In September 2016, he co-taught a Supreme Court seminar in China with Justice Samuel Alito. Following law school, he served as a law clerk in federal district court and as an assistant district attorney in New Orleans before joining LSU in 1975. While a professor, he has been as a consultant to USAID, USIA (since rolled into the State Department), the Justice Department, the U.S. Senate Judiciary Subcommittee on Separation of Powers, and the Office of Planning in the White House. He served on an ABA Task Force which issued the report, The Federalization of Crime (1998) and later as a consultant to the “Bi-Partisan Task Force on the Over- federalization of Crime” (2012-2014) created by the U.S. House Judiciary Subcommittee on Crime. Dr. Baker was a co-founder of the first iteration (1995) of Stratfor Inc., a global intelligence agency. He co-authored its first book: The Intelligence Edge (with Friedman, Friedman and Chapman; Crown Books/Random House 1997). In 2022, he began a short, weekly video podcast available on YouTube and Rumble, The Baker Brief.

Stephanie Barclay

Biography

Stephanie Barclay is a Professor of Law at Georgetown Law School, and the Faculty Director of the Georgetown Center for the Constitution. Her research focuses on the role our different democratic institutions play in protecting minority rights, particularly at the intersection of free speech and religious exercise. Barclay‘s work is published or is forthcoming in leading journals such as the Harvard Law Review, the Chicago Law Review, the University of Pennsylvania Law Review, and the Yale Law Journal Forum. One of her articles was also selected for the 2020 Stanford/Harvard/Yale Junior Faculty Forum. Her work has been featured in many media outlets, including The New York Times, The Wall Street Journal, The Washington Post, USA Today, Bloomberg BNA, The Hill, and Law 360. And her work has also been cited by the U.S. Supreme Court.

Prior to joining Georgetown, Barclay was twice voted Professor of the Year. Barclay has also litigated constitutional cases at both the trial and appellate level, including before the U.S. Supreme Court. Barclay served as a law clerk to Judge N. Randy Smith on the U.S. Court of Appeals for the Ninth Circuit, and to Justice Neil M. Gorsuch of the U.S. Supreme Court.

Barclay is a Faculty Affiliate at the Constitutional Law Center at Stanford Law School; and she is a Nootbaar Fellow at the Nootbaar Institute on Law, Religion, and Ethics at Pepperdine University. She currently serves as the Chair for the AALS Law and Religion Section and as a Member of the Executive Committee for the AALS Constitutional Law Section. She graduated summa cum laude from BYU Law School, where she was elected to the Order of the Coif. She is completing a Ph.D. in Law at Oxford University as a Clarendon Scholar and a Tang Scholar.

William P. Barr

Former United States Attorney General

Biography

William P. Barr was born on May 23, 1950 in New York City. Mr. Barr received his A.B. in government from Columbia University in 1971 and his M.A. in government and Chinese studies in 1973. From 1973 to 1977, he served in the Central Intelligence Agency before receiving his J.D. with highest honors from George Washington University Law School in 1977.

In 1978, Mr. Barr served as a law clerk under Judge Malcolm Wilkey of the U.S. Court of Appeals for the District of Columbia Circuit. Following his clerkship, Mr. Barr joined the Washington, D.C. office of the law firm of Shaw, Pittman, Potts & Trowbridge as an associate. He left the firm to work in the White House under President Ronald Reagan from 1982 to 1983 on the domestic policy staff, then returned to the law firm and became a partner in 1985.

Under President George H.W. Bush, Mr. Barr served as the Deputy Attorney General from 1990 to 1991; the Assistant Attorney General of the Office of Legal Counsel from 1989 to 1990; and the 77th Attorney General of the United States from 1991 to 1993. While serving at the Department, Mr. Barr helped create programs and strategies to reduce violent crime and was responsible for establishing new enforcement policies in a number of areas including financial institutions, civil rights, and antitrust merger guidelines. Mr. Barr also led the Department’s response to the Savings & Loan crisis; oversaw the investigation of the Pan Am 103 bombing; directed the successful response to the Talladega prison uprising and hostage taking; and coordinated counter-terrorism activities during the First Gulf War.

From 1994 to 2000, Mr. Barr served as Executive Vice President and General Counsel for GTE Corporation. Mr. Barr then served as Executive Vice President and General Counsel of Verizon from 2000 to 2008. At both GTE and Verizon, Mr. Barr led the legal, regulatory, and government affairs activities of the companies.

After retiring from Verizon in 2008, Mr. Barr advised major corporations on government enforcement matters, as well as regulatory litigation. Mr. Barr served as Of Counsel at Kirkland & Ellis LLP in 2009 and rejoined the firm in 2017.

President Donald Trump announced his intention to nominate Mr. Barr on December 7, 2018, and he was confirmed as the 85th Attorney General of the United States by the U.S. Senate on February 14, 2019. U.S. Supreme Court Chief Justice John Roberts administered the oath of office. Mr. Barr joins John Crittenden (1841 and 1850-1853) as one of only two people in U.S. history to serve twice as Attorney General.

Ronald A. Cass

Biography

Ronald A. Cass is Dean Emeritus of Boston University School of Law (where he was Dean from 1990-2004), President of Cass & Associates, PC, former Vice-Chairman and Commissioner of the U.S. International Trade Commission, former faculty member at Boston University School of Law and the University of Virginia Law School, and Distinguished Senior Fellow at the C. Boyden Gray Center for the Study of the Administrative State. Dean Cass also sits as an arbitrator for commercial, international, and intellectual property rights disputes, and is a former United States member of the Panel of Conciliators of the International Centre for Settlement of Investment Disputes. He is a member of the Council of the Administrative Conference of the United States and has received seven presidential appointments, spanning Presidents Ronald Reagan to Donald J. Trump.

As a law professor, lecturer, and scholar, Dean Cass has been teaching and writing about a wide array of legal issues on topics such as administrative law and regulation, antitrust, constitutional law, communications, intellectual property, international trade, separation of powers, and legal process. He has published more than 160 scholarly books, chapters, articles, and papers, including a leading casebook on administrative law. Dean Cass has taught judges as well as students in schools of law, economics, business, and public policy and has held academic appointments in the United States, Europe, and Latin America.

In addition to his academic work, Dean Cass has participated in numerous important legal cases as an amicus, consultant, or expert, and has advised businesses, law firms, investment funds, and government agencies on a range of trade, antitrust, intellectual property, and regulatory issues. He has a broad range of affiliations with professional groups, and has received numerous honors, fellowships and awards.

Dean Cass is a graduate of the University of Virginia and the University of Chicago Law School.

Paul D. Clement

Biography

Paul served as the 43rd Solicitor General of the United States from June 2005 until June 2008. Before his confirmation as Solicitor General, he served as Acting Solicitor General for nearly a year and as Principal Deputy Solicitor General for over three years.

Paul has argued over 100 cases before the United States Supreme Court, including McConnell v. FEC, Tennessee v. Lane, United States v. Booker, MGM v. Grokster, Hobby Lobby v. Burwell, Epic Systems Corp. v. Lewis, Rucho v. Common Cause, Facebook v. Duguid, and TransUnion v. Ramirez. Paul has argued more Supreme Court cases since 2000 than any lawyer in or out of government. He has also argued many important cases in the lower courts, including Walker v. Cheney, United States v. Moussaoui and NFL v. Brady.

Paul’s practice focuses on appellate matters, constitutional litigation and strategic counseling. He represents a broad array of clients in the Supreme Court and in federal and state appellate courts. Last year, for example, he successfully argued Supreme Court cases involving significant issues of energy regulation, statutory interpretation, state sovereign immunity and Article III standing, and successfully argued a trademark appeal in the Fourth Circuit, and a constitutional appeal before the en banc Eleventh Circuit.

Paul focuses on high-stakes appeals. In recent years, he successfully defended a $1.2 billion jury verdict for clients in a Tenth Circuit case, while securing the reversal of an over $2 billion jury verdict for another client in the Seventh Circuit and the approval of a nearly $1 billion dollar class action settlement in the Third Circuit. He has initiated major administrative law challenges and constitutional litigation against the federal government, such as the successful challenge to the HHS drug-pricing rule and threatened challenges that led to the withdrawal of the Treasury Department’s proposed cryptocurrency regulations. He also counsels clients on a variety of strategic legal questions, whether arising from pending legislation, government inquiries or ongoing litigation.

Paul has undertaken substantial pro bono engagements in the Supreme Court, such as twice successfully representing the defendant in Bond v. United States and successfully representing the Omaha Tribe in Nebraska v. Parker, the guardian ad litem in Adoptive Couple v. Baby Girl, the defendant in Sekhar v. United States, a high school football coach in Kennedy v. Bremerton, and the Little Sisters of the Poor. Paul’s pro bono representation also precipitated the federal government’s confession of error in United States v. Rojas.

Following law school, Paul clerked for Judge Laurence H. Silberman of the U.S. Court of Appeals for the D.C. Circuit and for Associate Justice Antonin Scalia of the U.S. Supreme Court. After his clerkships, he went on to serve as Chief Counsel of the U.S. Senate Subcommittee on the Constitution, Federalism and Property Rights.

Paul is a Distinguished Lecturer in Law at the Georgetown University Law Center, where he has taught in various capacities since 1998. He also serves as a Senior Fellow of the Law Center’s Supreme Court Institute. He is the Justice Joseph Story Distinguished Practitioner in Residence at the Gray Center at Scalia Law School.

Jennifer Walker Elrod

Chief Judge, United States Court of Appeals, Fifth Circuit

Biography

Jennifer Walker Elrod is the Chief Judge of the United States Court of Appeals for the Fifth Circuit. She was nominated to the Fifth Circuit in 2007, and she served as a Circuit Judge on the court until assuming the role of Chief Judge in October 2024. Prior to serving as a Circuit Judge, Chief Judge Elrod was appointed and then twice elected Judge of the 190th District Court of Harris County, Texas, where she spent over five years presiding over more than 200 jury and non-jury trials.

Chief Judge Elrod graduated cum laude from Harvard Law School, where she was an active member of the Harvard Federalist Society, an Ames Moot Court finalist, and a Senior Editor of the Harvard Journal of Law & Public Policy. She clerked for the Honorable Sim Lake in the Southern District of Texas. Before serving as a judge, Chief Judge Elrod worked in private practice, focusing on civil litigation, antitrust, and employment matters.

She has been repeatedly recognized for her work as a jurist, as well as for her pro bono work and contributions to the community. She has been named the 2022 Texas Review of Law & Politics’ Jurist of the Year, the 2018 Harvard Federalist Society’s Alumni of the Year, the 2016–17 Texas Association of Civil Trial and Appellate Specialists’ Appellate Judge of the Year, and the 2008 Mexican-American Bar Association of Texas’s Judge of the Year.

Chief Judge Elrod is actively engaged in the academic and legal communities. Chief Judge Elrod currently serves on the Board of Directors and as the Jurist-in-Residence at the South Texas College of Law, where she teaches civil procedure and First Amendment law. She is also a member of the American Law Institute and of the Board of Advisors for the Harvard Journal of Law & Public Policy, and she is a former member of the Board of Regents of her alma mater, Baylor University, and the Board of Visitors at Brigham Young University Law School. She previously served as the Chair of the Codes of Conduct Committee for the Judicial Conference of the United States. She has also served as the M.D. Anderson Visiting Public Service Professor at the Texas Tech University School of Law and as Jurist-in-Residence at Brigham Young University Law School, and she has taught legal writing at the University of Houston Law Center. She presented the Lewis F. Powell, Jr. Distinguished Lecture at the Washington and Lee University School of Law and is a frequent speaker on the topics of trial and appellate procedure, ethics, employment law, and constitutional law. Chief Judge Elrod also serves on the board of the Garland R. Walker Inn of Court, and co-produces an annual musical CLE, for which her pupilage group has won multiple national awards.

Kurt Damian Engelhardt

Judge, United States Court of Appeals, Fifth Circuit

Biography

Kurt D. Engelhardt was nominated for a seat on the United States Fifth Circuit Court of Appeals by President Donald J. Trump, confirmed by the Senate on May 9, 2018, and officially sworn in as a United States Circuit Judge on May 15, 2018. Judge Engelhardt is based in New Orleans, Louisiana, at the John Minor Wisdom U.S. Court of Appeals Building.

Judge Engelhardt was previously nominated for a seat on the United States District Court for the Eastern District of Louisiana by President George W. Bush, and upon confirmation, was officially sworn in as a United States District Judge on December 14, 2001. While a District Judge, Judge Engelhardt served by designation on nine different panels of the United States Fifth Circuit Court of Appeals. On October 1, 2015, he became Chief United States District Court Judge for the Eastern District of Louisiana, a position he held until joining the United States Fifth Circuit on May 15, 2018.

Judge Engelhardt attended Brother Martin High School in New Orleans, where he graduated with honors in 1978. He attended Louisiana State University in Baton Rouge, from which he graduated with a Bachelor of Arts in history in 1982. In the Fall of 1982, Judge Engelhardt commenced his legal education at the Paul M. Hebert Law Center at Louisiana State University, graduating in May of 1985.

Judge Engelhardt served a two-year clerkship with Judge Charles Grisbaum, Jr. of the Louisiana Fifth Circuit Court of Appeal, located in Gretna, Louisiana. From there, he became associated with the Metairie law firm of Little, Metzger and Lamz (APLC), and worked in the downtown New Orleans office of that firm in 1988-89. He then joined the law firm of Hailey, McNamara, Hall, Larmann & Papale, became a partner in July 1998, and practiced there until his confirmation to the federal bench in December 2001.

In 1995, Judge Engelhardt was nominated for a spot on the nine-member Louisiana Judiciary Commission, and was appointed by the Governor to serve a four-year term on that body. In 1998, he was elected by his fellow commission members to serve as Chairman, in which capacity he presided over the Commission’s trials of formal charges lodged against sitting state judges. His work on the Judiciary Commission has been cited for its excellence by the Louisiana Supreme Court.

Judge Engelhardt is a member of the Advisory Board of the New Orleans Chapter of The Federalist Society; a past member of the United States Judicial Conference Committee on Federal-State Jurisdiction; a member of the Board of Directors (and past president) of the New Orleans Chapter of the Federal Bar Association; a member of the American Judicature Society; and a member of the Federal Circuit Bar Association. He has served on the Fifth Circuit's Criminal Pattern Jury Instruction Committee, charged with updating and/or drafting pattern jury instructions for district judges within the jurisdiction of the United States Fifth Circuit. Recently, he was appointed by Fifth Circuit Chief Judge Carl Stewart to chair the Circuit's Judicial Impairment Protocol Committee, established to create a framework for the judiciary to internally address disabilities of all types which may impact a judge's ability to handle his/her docket.

Judge Engelhardt is also a member of the American Bar Association, Jefferson Bar Association, Louisiana State Bar Association, New Orleans Bar Association, and the Phi Alpha Delta Law Fraternity. Judge Engelhardt serves on the Board of Directors of the Cancer Association of Greater New Orleans.

Tara Leigh Grove

Vinson & Elkins Chair in Law, University of Texas at Austin School of Law

Biography

Tara Leigh Grove is the Vinson & Elkins Chair in Law at the University of Texas School of Law. Grove graduated summa cum laude from Duke University and magna cum laude from Harvard Law School, where she served as the Supreme Court Chair of the Harvard Law Review. Grove clerked for Judge Emilio Garza on the U.S. Court of Appeals for the Fifth Circuit, and then spent four years as an attorney for the U.S. Department of Justice, Civil Division, Appellate Staff, where she argued fifteen cases in the courts of appeals.

Grove’s research focuses on the federal judiciary, interpretive theory, and the constitutional separation of powers. She has published with such prestigious law journals as the Harvard Law Review, the Yale Law Journal, the Columbia Law Review, the University of Pennsylvania Law Review, the New York University Law Review, the University of Chicago Law Review, the Virginia Law Review, the Texas Law Review, the Cornell Law Review, the Northwestern University Law Review, and the Vanderbilt Law Review. Grove has received awards for both her research and her teaching.

In 2021, Grove served on the Presidential Commission on the Supreme Court of the United States, a bipartisan commission created by President Biden and charged with examining proposals for Supreme Court reform. Since 2022, Grove has worked on the Princeton Initiative on Reclaiming the Constitutional Powers of Congress, which brings together former members of Congress, political scientists, and law professors. Grove serves as the Co-Chair of the section on the Appointments Process for the Princeton Initiative. Grove is a co-author of Low & Jeffries' Federal Courts and the Law of Federal-State Relations, a leading federal courts casebook, and she has served as the Chair of the Federal Courts Section of the Association of American Law Schools. Grove has been a visiting professor at both Harvard Law School and Northwestern Pritzker School of Law.

Deepak Gupta

Biography

Deepak Gupta is the founding principal of Gupta Wessler PLLC. He focuses on Supreme Court, appellate, and complex litigation on a wide range of issues, including constitutional law, class actions, and consumers’ and workers’ rights.

Deepak is “known as a skilled appellate lawyer” (New York Times), “one of the emerging giants of the appellate and the Supreme Court bar,” a “heavy hitter,” and a “principled” and “incredibly talented lawyer” (Law 360). Deepak regularly appears in the U.S. Supreme Court and appellate courts nationwide. In the 2016-2017 U.S. Supreme Court term, Deepak’s firm was counsel of record for parties in three merits cases; he was lead counsel in two, prevailing in both. Beyond the Supreme Court, Deepak has handled appeals in every federal circuit and seven state supreme courts. He is frequently sought out by trial lawyers to defend their most consequential victories or resurrect worthy claims on appeal—often after years of hard-fought litigation. He also works with co-counsel to design cases from the ground up—focusing on class actions and administrative and constitutional challenges. Before founding the firm in 2012, Deepak served as Senior Counsel for Litigation and Senior Counsel for Enforcement Strategy at the Consumer Financial Protection Bureau. As the first appellate litigator hired under Elizabeth Warren’s leadership, he launched the Bureau’s amicus program, defended its regulations, and worked with the Solicitor General’s office on Supreme Court matters. For seven years previously, he was an attorney at Public Citizen Litigation Group, where he founded and directed the Consumer Justice Project and was the Alan Morrison Supreme Court Project Fellow. Before that, he worked on voting rights litigation at the Civil Rights Division of the U.S. Department of Justice, prisoners’ rights litigation at the ACLU, and religion clause litigation at Americans United for Separation of Church and State.

Deepak frequently engages in public advocacy and speaking, has testified multiple times before the U.S. House of Representatives and U.S. Senate, and appears frequently in the national print and broadcast media. He is currently a 2018-2019 Wasserstein Public Interest Fellow at Harvard Law School and has previously taught courses on public interest law and appellate advocacy as an Adjunct Professor of Law at Georgetown and American universities. He served as a law clerk to Judge Lawrence K. Karlton of the U.S. District Court for the Eastern District of California and studied law at Georgetown, Sanskrit at Oxford, and philosophy at Fordham.

Christopher Hajec

Director of Litigation, Immigration Reform Law Institute

Biography

Mr. Hajec joined the Immigration Reform Law Institute (IRLI) in 2017 as its Director of Litigation, and is responsible for overseeing IRLI’s public interest litigation. Previously, he has focused his career on constitutional and other civil rights law in the public interest, and has had an abiding concern about the many adverse effects of illegal and excessive legal immigration on American jobs and communities.

At IRLI, in addition to representing plaintiffs in immigration-related civil lawsuits, he has overseen the drafting and filing of nearly 100 briefs, mostly amicus curiae briefs in defense of the Trump administration’s immigration initiatives, which have been subjected to an unprecedented degree of legal assault by well-funded interest groups.

Prior to joining IRLI, Mr. Hajec was an attorney at the Center for Individual Rights (CIR), where he litigated a string of high-profile cases, including the defense of videographer James O’Keefe in suits brought by former ACORN employees, a class action suit on behalf of Asian American students discriminated against by the New York City public schools, and a case that resulted in the U.S. Court of Appeals for the Fifth Circuit’s striking down Texas’s psychologists licensing statute as an overbroad restriction on free speech.

Before CIR, Mr. Hajec was an officer in the Navy Judge Advocate General’s Corps, where he served as a defense counsel before courts-martial and then as Appellate Government Counsel, arguing over 100 appeals before the Navy-Marine Corps Court of Criminal Appeals and the Court of Appeals for the Armed Forces. He received the Navy Commendation Medal for his legal work, and also because of his poor handling of an emergency during a hurricane.

He received his law degree from the University of Pennsylvania Law School and his undergraduate degree, cum laude, from the University of Michigan. He has a Ph.D. in philosophy from the University of Miami, and studied philosophy and sociology at Oxford University.

Kristin E. Hickman

Biography

Professor Kristin E. Hickman is the McKnight Presidential Professor in Law, a Distinguished McKnight University Professor, and Harlan Albert Rogers Professor in Law at the University of Minnesota Law School. She also has taught at Harvard Law School and Northwestern University School of Law. Professor Hickman teaches and writes primarily in the areas of administrative law, tax administration, and statutory interpretation. Her articles on these topics have appeared in the Columbia Law Review, Cornell Law Review, Virginia Law Review, Duke Law Journal, and other publications. She also co-authors the Administrative Law Treatise with Richard J. Pierce, Jr., and a casebook on federal administrative law with Pierce and Christopher J. Walker. Her scholarly work has been cited several times in opinions of the United States Supreme Court as well as regularly in lower court judicial opinions and court briefs.

In 2018-19, Professor Hickman served as Special Adviser to the Administrator of the Office of Information and Regulatory Affairs in Washington, D.C. She presently serves as a Senior Fellow, and previously served as a public member and chair of the judicial review committee, for the Administrative Conference of the United States. She also is a Fellow of the American College of Tax Counsel.

Professor Hickman received her B.S. degree in business administration with a concentration in accounting and a secondary major in history from Trinity University in San Antonio, Texas. After practicing for several years as a certified public accountant, Professor Hickman earned her J.D. degree, magna cum laude, from Northwestern University School of Law, where she was awarded the Raoul Berger Prize and the Lowden Wigmore Prize for her scholarly writings. Following law school, Professor Hickman clerked for The Honorable David B. Sentelle of the United States Court of Appeals for the District of Columbia Circuit and practiced law as an associate with the Chicago office of Skadden, Arps, Slate, Meagher & Flom, concentrating on corporate and international tax transactions and matters.

Donald Kohn

Biography

Donald Kohn holds the Robert V. Roosa Chair in International Economics and is a senior fellow in the Economic Studies program at the Brookings Institution. He also currently serves as an external member of the Financial Policy Committee at the Bank of England. Kohn is a 40-year veteran of the Federal Reserve system, serving as member and then vice chair of the Board of Governors from 2002-2010. Kohn is an expert on monetary policy, financial regulation, and macroeconomics and has written extensively on these issues. Prior to taking office as a member of the Board of Governors he served in a number of staff roles at the Board, including secretary of the Federal Open Market Committee (1987-2002) and director of the Division of Monetary Affairs (1987-2001). He has also served as chairman of the Committee on the Global Financial System (CGFS), a central bank panel that monitors and examines broad issues related to financial markets and systems. He advised Federal Reserve Chairman Ben Bernanke throughout the 2008-2009 financial crisis and served as a key adviser to former Fed Chairman Alan Greenspan. He was awarded the Distinguished Achievement Award from The Money Marketeers of New York University (2002), lifetime achievement awards from The Clearing House (2012) and Central Banking magazine (2017), the Distinguished Alumni Award from the College of Wooster (1998), and the Honorary Degree, Doctor of Laws, from the College of Wooster (2006). In 2016, he was made honorary Commander of the British Empire. Kohn was born in November 1942 in Philadelphia. He received a B.A. in economics in 1964 from the College of Wooster and a Ph.D. in economics in 1971 from the University of Michigan. He is married and has two adult children and four grandchildren.

Richard J. Lazarus

Biography

Richard Lazarus is the Howard J. and Katherine W. Aibel Professor of Law at Harvard Law School, where he teaches Environmental Law, Natural Resources Law, Supreme Court Advocacy, and Torts. Professor Lazarus has represented the United States, state and local governments, and environmental groups in the United States Supreme Court in more than 40 cases and has presented oral argument in 14 of those cases, most recently for respondent in Murr v. Wisconsin (2017). He also filed briefs on behalf of governmental parties in many other regulatory takings cases including Tahoe Sierra Preservation Counsel v. Tahoe Regional Planning Agency (2002), Palazzolo v. Rhode Island (2001), Suitum v. Tahoe Regional Planning Agency (1997), Dolan v. City of Tigard (1004), Lucas v. South Carolina Coastal Council (1992), Nollan v. California Coastal Council (1987), San Diego Gas & Electric v. City of San Diego (1981), and Agins v. City of Tiburon (1980). He writes broadly on topics relating to Supreme Court decision-making, focusing on both advocacy before and within the Court, and on environmental law. He will be publishing next year a book on the Supreme Court’s 2007 decision in Massachusetts v. EPA, which tells the inside story of the case based on interviews with the relevant Executive Branch officials, competing advocates, and judges and Justices on the D.C. Renée Lettow Lerner

Biography

Renée Lettow Lerner is Donald Phillip Rothschild Research Professor of Law at George Washington University Law School.

Professor Lerner works in the fields of U.S. and English legal history, civil and criminal procedure, and comparative law. She advises judges, lawyers, and government officials from the United States and countries in Europe, Latin America, and Asia about the differences between adversarial and nonadversarial legal systems.

She writes extensively about the history of American juries. Her work includes not only scholarly articles, but also online publications intended for a broader audience of legal professionals and the public. In many different settings, she has debated the role of juries with other academics and with lawyers. She has a book forthcoming with Oxford University Press in the Very Short Introduction Series entitled “The Jury.” She is also working on a book about the American civil jury, from the colonial period to the present.

She is the author, with John Langbein and Bruce Smith, of the book History of the Common Law: The Development of Anglo-American Legal Institutions (2009).

Nelson Lund

Distinguished University Professor, Antonin Scalia Law School, George Mason University

Biography

University Professor Nelson Lund is the author of Rousseau’s Rejuvenation of Political Philosophy: A New Introduction. He has also written widely in the field of constitutional law, including articles on constitutional interpretation, federalism, separation of powers, the Second Amendment, the Commerce Clause, the Speech or Debate Clause, the Equal Protection Clause, and the Uniformity Clause. In addition, he has published articles in the fields of employment discrimination and civil rights, the legal regulation of medical ethics, and the application of economic analysis to legal institutions and legal ethics.

Professor Lund graduated from St. John's College in Annapolis, Maryland, after which he received an MA in philosophy from the Catholic University of America and a PhD in political science from Harvard University. He left the faculty of the University of Chicago to attend its law school, where he served as executive editor of the University of Chicago Law Review and chapter chairman of the Federalist Society for Law and Public Policy Studies. After law school, he held positions at the United States Department of Justice in the Office of the Solicitor General and the Office of Legal Counsel. He also served as a law clerk to the Honorable Patrick E. Higginbotham of the United States Court of Appeals for the Fifth Circuit and to the Honorable Sandra Day O'Connor of the United States Supreme Court. Following his clerkship with Justice O'Connor, Professor Lund served in the White House as associate counsel to the president from 1989 to 1992.

Since joining the faculty at George Mason University's Antonin Scalia Law School, Professor Lund has taught Constitutional Law, Legislation, Federal Election Law, Employment Discrimination, State and Local Government, and seminars on the Second Amendment and on a variety of topics in Jurisprudence.

Michael W. McConnell

Biography

Michael W. McConnell is the Richard and Frances Mallery Professor and Faculty Director of the Constitutional Law Center at Stanford Law School, and a Senior Fellow at the Hoover Institution. From 2002 to 2009, he served as a Circuit Judge on the United States Court of Appeals for the Tenth Circuit. He was nominated by President George W. Bush, a Republican, and confirmed by a Democratic Senate by unanimous consent. McConnell has previously held chaired professorships at the University of Chicago and the University of Utah, and visiting professorships at Harvard and NYU. He teaches courses on constitutional law, constitutional history, First Amendment, and interpretive theory. He has published widely in the fields of constitutional law and theory, especially church and state, equal protection, and separation of powers. His book, “The President Who Would Not Be King: Executive Power Under the Constitution,” was published by Princeton University Press in 2020, based on the Tanner Lectures in Human Values, which he delivered at Princeton in 2019. His latest book, co-authored with Nathan Chapman, “Agreeing to Disagree: How the Establishment Clause Protects Religious Diversity and Freedom of Conscience,” was published by Oxford University Press in mid-2023. McConnell has argued sixteen cases in the United States Supreme Court, most recently Carney v. Adams (2020). defending a provision of the Delaware Constitution requiring political balance on that state’s courts. More recently, he was co-counsel in Gonzalez v. Google. He earned his B.A. from Michigan State University and his J.D. from the University of Chicago, and has received honorary degrees from Notre Dame University and Michigan State. He served as law clerk to Supreme Court Justice William J. Brennan, Jr. and D.C. Circuit Chief Judge J. Skelly Wright. He has been Assistant General Counsel of the Office of Management & Budget, Assistant to the Solicitor General of the Department of Justice, and a member of the President’s Intelligence Oversight Board. He is Senior of Counsel to the law firm Wilson, Sonsini, Goodrich & Rosati, and is co-chair of Meta’s Oversight Review Board.

Bernadette Meyler

Carl and Shelia Spaeth Professor of Law; Associate Dean for Research and Intellectual Life, Stanford Law School

Biography

Bernadette Meyler, JD ’03, is a scholar of British and American constitutional law and of law and the humanities. She returned in 2013 to Stanford Law School, where she had previously served as Leah Kaplan Visiting Professor in Human Rights. Her research and teaching bring together the sometimes surprisingly divided fields of legal history and law and literature. They also examine the long history of constitutionalism, reaching back into the English common law ancestry of the U.S. Constitution. Professor Meyler’s current book projects stem from these respective areas of her scholarship. Theaters of Pardoning (Cornell UP, forthcoming 2019) demonstrates that the representation of pardoning tracks changing conceptions of sovereignty within the plays and politics of seventeenth-century England. In doing so, the book considers how the shared audiences of dramatic and historical tragicomedy—whether Kings, students at the Inns of Court, or potential jurors—brought concepts from the literary into the legal arena and back again. Common Law Originalism shifts to the American context, looking at the multiple eighteenth-century common law meanings—both colonial and English—of various constitutional terms and phrases. Based on this variety, as well as on the practices of common law interpretation with which members of the Founding generation were familiar, the book argues that we should, in large part, reject the pursuit of a singular and determinate original meaning; instead, it contends, we must embrace a more vigorous debate in the present over contested constitutional meanings. Professor Meyler is also the co-editor of several collections of essays in law and the humanities designed to introduce scholars and students to the field, including, with Elizabeth Anker, New Directions in Law and Literature (Oxford UP, 2017) and, with Simon Stern and Maksymilian Del Mar, The Oxford Handbook of Law and the Humanities (Oxford UP, forthcoming 2019).

After receiving her BA in Literature with a focus on Classics at Harvard University, Professor Meyler obtained her JD from Stanford Law School and completed a PhD in English at UC, Irvine as a Mellon Fellow in Humanistic Studies and a Chancellor’s Fellow. Following law school, Professor Meyler clerked for the Hon. Robert A. Katzmann of the U.S. Court of Appeals for the Second Circuit.

Professor Meyler previously taught at Cornell University, where she served, most recently, as Professor of Law and English and Faculty Director of Research at the Cornell Law School. She also visited Princeton University as the inaugural Mellon/LAPA Fellow in Law and the Humanities.

Norman J. Ornstein

Resident Scholar, American Enterprise Institute

Biography

Norman Ornstein is a resident scholar at the American Enterprise Institute. He is a contributing editor and writer for The Atlantic, and has been an election eve analyst for CBS News and BBC news. He is also Chairman of the Board of the Campaign Legal Center.

He served as a senior counselor to the Continuity of Government Commission and co-directed the AEI-Brookings Project on alternatives to the Independent Counsel Act. Mr. Ornstein led a working group of scholars and practitioners that helped shape the law, known as McCain-Feingold, that reformed the campaign financing system. He was elected as a fellow of the American Academy of Arts and Sciences in 2004.

His many books include Intensive Care: How Congress Shapes Health Policy (AEI, 2006); The Broken Branch: How Congress Is Failing America and How to Get It Back on Track, with Thomas E. Mann (Oxford University Press, 2006, named by the Washington Post one of the best books of 2006 and called by the Economist "a classic"); and the New York Times bestseller, It's Even Worse Than It Looks: How the American Constitutional System Collided With the New Politics of Extremism, also with Tom Mann, published in May 2012 by Basic Books, and updated in a paperback version in September 2013, named Book of the Year by Ezra Klein’s Wonkblog, one of the ten best books on politics in 2012 by The New Yorker, and one of the best books of 2012 by the Washington Post. An expanded edition, retitled “It’s Even Worse Than It Was,” was published in spring 2016. Ornstein has a BA from the University of Minnesota and an MA and PhD from the University of Michigan. He received an honorary Doctor of Laws degree from his alma mater in 2007. Ornstein was spotlighted as one of 2012’s 100 Top Global Thinkers by Foreign Policy Magazine.

Richard H. Pildes

Sudler Family Professor of Constitutional Law, New York University School of Law

Biography

Richard H. Pildes is one of the nation’s leading scholars of constitutional law and a specialist in legal issues affecting democracy. He is a Member of the American Academy of Arts and Sciences and the American Law Institute, and has received recognition as a Guggenheim Fellow and a Carnegie Scholar. His acclaimed casebook, The Law of Democracy: Legal Structure of the Political Process (now in its fourth edition), helped create an entirely new field of study in the law schools. The Law of Democracy systematically explores legal and policy issues concerning the structure of democratic elections and institutions, such as the role of money in politics, the design of election districts, the regulation of political parties, the design of voting systems, the representation of minority interests in democratic institutions, and similar issues. He has written extensively on the rise of political polarization in the United States, the Voting Rights Act, the dysfunction of America’s political processes, the role of the Supreme Court in overseeing American democracy, the powers of the American President and Congress, and he has criticized excessively “romantic” understandings of democracy. In addition to his scholarship on these issues, he has written on national-security law, the design of the regulatory state, and American constitutional history and theory.

Respect for his expertise in these areas is reflected in frequent citations of his work in U.S. Supreme Court opinions, the translation of his work into many languages, and his frequent public lectures and appearances around the world, including his nomination with the NBC News Team for an Emmy Award for coverage of the 2000 Presidential election litigation.

His work has been translated and published in Chinese, French, Spanish, and Portuguese. In addition to his scholarship, Professor Pildes plays an active role litigating in these areas. He has won two cases before the United States Supreme Court, including a 2015 victory in Alabama Democratic Conference v. Alabama, a case involving race and redistricting. He served as counsel to a group of former chairmen of the Securities and Exchange Commission in litigation defending the constitutionality of the Sarbanes-Oxley Act; as counsel in election litigation to the Puerto Rico Electoral Commission; as counsel to the government of Puerto Rico; as a federal court-appointed independent expert on voting rights litigation; and as counsel in successful Supreme Court litigation that challenged the way the United States Tax Court operated. He was also a senior legal advisor to the 2008 and 2012 campaigns of President Obama.

Pildes received his A.B. in physical chemistry summa cum laude from Princeton, and his J.D. magna cum laude from Harvard, where he served as Supreme Court Note Editor on the Harvard Law Review. He clerked for Judge Abner J. Mikva of the U.S. Court of Appeals for the District of Columbia Circuit and for Justice Thurgood Marshall of the U.S. Supreme Court. After practicing law in Boston, he began his academic career at the University of Michigan Law School, before joining the NYU School of Law in 2001.

Andrew J. Pincus

Andrew Pincus is a partner in Mayer Brown LLP resident in Washington, D.C. His practice focuses on Supreme Court and appellate litigation.

Andy has argued 29 cases in the Supreme Court of the United States, including Lamps Plus, Inc. v. Varela and Frank v. Gaos in the October 2018 Term; as well as his recent victories in Impression Products, Inc. v. Lexmark International, Inc. (2017); Kindred Nursing Home Centers Limited Partnership v. Alex J. Pollock

Biography

Alex J. Pollock is a Senior Fellow with the Mises Institute, providing thought and policy leadership on financial issues and the study of financial systems. His work includes cycles of booms and busts, financial crises with their political responses, housing finance, government-sponsored enterprises, risk and uncertainty, central banking, banking and financial regulation, corporate governance, retirement finance, student loans, and the politics of finance.

He previously served as the Principal Deputy Director of the Office of Financial Research in the U.S. Treasury Department 2019-2021. He was a Distinguished Senior Fellow with the R Street Institute 2015-2019 and 2021, and a resident fellow at the American Enterprise Institute, 2004-2015. Among the many aspects of his AEI work, he developed the One Page Mortgage Form to give borrowers in clear form the key information they need in order to know what they are committing themselves to. He was President and CEO of the Federal Home Loan Bank of Chicago from 1991 to 2004. There he invented the Mortgage Partnership Finance program, which successfully created front-end mortgage credit risk sharing beginning in 1997. His decades of banking experience include being a Visiting Scholar at the Federal Reserve Bank of St. Louis, 1991.

Pollock was a director of the CME Group 2004-2019 and of Ascendium Education Group 1989-2019. He is a director and past-chairman of the Great Books Foundation and a past president of the International Union for Housing Finance.

He is the co-author of Surprised Again! - The COVID Crisis and the New Market Bubble (2022), and the author of Finance and Philosophy—Why We’re Always Surprised (2018) and Boom and Bust: Financial Cycles and Human Prosperity (2011), as well as numerous articles and Congressional testimony.

Saikrishna Prakash

Biography

Professor Saikrishna Prakash’s scholarship focuses on separation of powers, particularly executive powers. He teaches Constitutional Law, Foreign Relations Law and Presidential Powers at the Law School.

Prakash’s most recent book, “The Living Presidency: An Originalist Argument Against Its Ever-Expanding Powers,” was published by Harvard Belknap Press in 2020. He also authored “Imperial from the Beginning: The Constitution of the Original Executive” (Yale University Press, 2015). The former book focuses on the modern presidency while the latter considers the presidency of the Founders.

Prakash has authored over 75 law review articles. Among them are “Of Synchronicity and Supreme Law” in the Harvard Law Review, “The Indefensible Duty to Defend” in the Columbia Law Review, and “50 States, 50 Attorneys General and 50 Approaches to the Duty to Defend” and “The Executive Power Over Foreign Affairs” in the Yale Law Journal.

Prakash has published op-eds in The New York Times, The Wall Street Journal and the Los Angeles Times. At the request of Democrats and Republicans, he has testified before Congress on matters of presidential removal, the Mueller Report and how Congress might better check the presidency. He is currently a Miller Center Senior Fellow. In 2015, he received the Roger Traynor award for faculty scholarship. In the same year, he received an honorable mention from the American Society of Legal Writers for his book “Imperial from the Beginning.” He has given named lectures at William & Mary Law School, Princeton University and Toledo Law School, and keynote addresses at several conferences.

Silberman of the U.S. Court of Appeals for the District of Columbia Circuit and for Justice Clarence Thomas of the U.S. Supreme Court. After practicing in New York for two years, he served as a visiting professor at the University of Illinois College of Law and as an associate professor at Boston University School of Law. William H. Pryor

Biography

William H. Pryor Jr. serves as Chief Circuit Judge on the United States Court of Appeals for the Eleventh Circuit.

In 2013–18, he served on the United States Sentencing Commission and, in 2017–18, served as Acting Chair.

He has taught as a visiting professor at the University of Alabama School of Law and previously taught as an adjunct professor at the Cumberland School of Law of Samford University.

He served as the 45th Attorney General of Alabama from 1997 to 2004. When he took office, he was the youngest attorney general in the nation. In his reelection, he received the highest percentage of votes of any statewide candidate.

He graduated magna cum laude from Tulane Law School where he finished first in the common-law curriculum and was editor in chief of the Tulane Law Review. He then served as a law clerk for Judge John Minor Wisdom of the U.S. Court of Appeals for the Fifth Circuit.

He is a member of The American Law Institute and an Adviser for the RESTATEMENT OF THE LAW THIRD, CONFLICT OF LAWS. Stephen E. Sachs

Biography

Stephen E. Sachs is the Antonin Scalia Professor of Law at Harvard Law School, where he teaches civil procedure, conflict of laws, and seminars on constitutional law. His research focuses on the law and theory of constitutional interpretation, the jurisdiction of state and federal courts, the history of procedure and private law, and the role of the general common law in the U.S. legal system.

Sachs has authored numerous articles, essays, and book chapters. He is an elected member of the American Law Institute, an adviser to the ALI’s project on the Restatement of the Law (Third), Conflict of Laws, a former member of the Judicial Conference’s Advisory Committee on Appellate Rules, and a founding member of the Academic Freedom Alliance.

In 2020, Sachs received the Federalist Society’s Joseph Story Award, which recognizes a young academic who has demonstrated excellence in legal scholarship, a commitment to teaching, a concern for students, and who has made a significant public impact in a manner that advances the rule of law in a free society.

Sachs previously taught at Duke University School of Law and as a visiting professor at the University of Chicago Law School. Jefferson B. Sessions

Biography

Jeff Sessions served as the 84th Attorney General of the United States from February 9, 2017 until November 7, 2018.

Prior to becoming Attorney General, Mr. Sessions served as a United States Senator for Alabama since 1996. As a United States Senator, he focused his energies on maintaining a strong military, upholding the rule of law, limiting the role of government, and providing tax relief to stimulate economic growth and to empower Americans to keep more of their hard-earned money.

Mr. Sessions was born in Selma, Alabama on December 24, 1946, and grew up in Hybart, the son of a country store owner. Growing up in the country, Sessions was instilled with certain core values – honesty, hard work, belief in God and parental respect – that define him today. In 1964, he became an Eagle Scout and thereafter received the Distinguished Eagle Scout Award. After attending school in nearby Camden, Sessions attended Huntingdon College in Montgomery, graduating with a Bachelor of Arts degree in 1969. He received a Juris Doctorate degree from the University of Alabama in 1973. Sessions served in the United States Army Reserve from 1973 to 1986, ultimately attaining the rank of Captain. He still considers that period to be one of the most rewarding chapters of his life.

Sessions’ interest in the law led to a distinguished legal career, first as a practicing attorney in Russellville, Alabama, and then in Mobile. Following a two-year stint as Assistant United States Attorney for the Southern District of Alabama (1975-1977), Sessions was nominated by President Reagan in 1981 and confirmed by the Senate to serve as the United States Attorney for the Southern District of Alabama, a position he held for 12 years. Sessions was elected Alabama Attorney General in 1995, serving as the State’s chief legal officer until 1996, when he entered the United States Senate.

Sessions and his wife, Mary Blackshear Sessions, originally of Gadsden, Alabama, have three children, Mary Abigail Reinhardt, Ruth Sessions Walk, and Sam. They have seven granddaughters, Jane Ritchie, Alexa, Gracie, Sophia, Hannah, Joanna, and Phoebe, and three grandsons, Jim Beau, Lewis, and Nicholas.

Ilya Shapiro

Ilya Shapiro is a senior fellow and director of constitutional studies at the Manhattan Institute and a contributing editor of City Journal. Previously he was executive director and senior lecturer at the Georgetown Center for the Constitution, and before that a vice president of the Cato Institute.

Shapiro is the author of Lawless: The Miseducation of America’s Elites (2025) and Supreme Disorder: Judicial Nominations and the Politics of America’s Highest Court (2020), coauthor of Religious Liberties for Corporations? (2014), and editor of 11 volumes of the Cato Supreme Court Review (2008-18). Paul Sheard is Senior Fellow of the Mossavar-Rahmani Center for Business and Government at Harvard Kennedy School. Previously, he was Vice Chairman of S&P Global, after serving as Executive Vice President and Chief Economist. Earlier, he held chief economist positions at Standard & Poor’s Ratings Services, Nomura Securities and Lehman Brothers, and was Head of Japan Equity Investments at Baring Asset Management. Sheard was on the faculty of the Australian National University (ANU) and of Osaka University, and was a visiting assistant professor at Stanford University and foreign visiting scholar at the Bank of Japan.

Sheard is a member of the World Economic Forum’s Global Future Council on the New Economic Agenda (2018-2020) and was a member of the WEF’s Global Agenda Council on the International Monetary System (2010-2012). Lawrence Solum

Biography

Lawrence B. Solum is an internationally recognized legal theorist who works in constitutional theory, procedure and the philosophy of law. Solum contributes to debates in constitutional theory and normative legal theory. He is especially interested in the intersection of law with the philosophy of language and with moral and political philosophy. His series of articles on constitutional originalism have shaped contemporary thinking about the great debate between originalism and constitutional theory. Solum’s original theory of the fundamental nature and purpose of law, “Virtue Jurisprudence,” has been debated and discussed in Asia, Europe and North America. He also works on problems of law and technology, including Internet governance, copyright policy and patent law. His pathbreaking article, “Legal Personhood for Artificial Intelligences,” published in the early 1990s, is widely acknowledged as far ahead of its time.

Solum received his J.D. magna cum laude from Harvard Law School and received his B.A. with highest departmental honors in philosophy from the University of California at Los Angeles. Jonathan E. Taylor

Jonathan E. Taylor is a principal at Gupta Wessler PLLC in Washington, DC, where he focuses on representing plaintiffs and public-interest clients in Supreme Court, appellate, and constitutional litigation.

Since joining the firm in 2012, Jon has presented argument before the U.S. Courts of Appeals for the First, Eighth, Ninth, Eleventh, and District of Columbia Circuits, as well as the Supreme Court of Alaska. He has also been a principal author of dozens of briefs filed in the U.S. Supreme Court and all levels of the state and federal judiciaries. John Yoo is the Emanuel Heller Professor of Law. He is also Distinguished Visiting Scholar, School of Civic Leadership and Senior Research Fellow, Civitas Institute, at the University of Texas at Austin. He is also a Nonresident Senior Fellow at the American Enterprise Institute.

His most recent book, The Politically Incorrect Guide to the Supreme Court, co-authored with Robert Delahunty, was published in 2023. Professor Yoo’s other books include Defender-in-Chief: Trump’s Fight for Presidential Power; Striking Power: How Cyber, Robots, and Space Weapons Change the Rules for War, Point of Attack: Preventive War, International Law, and Global Welfare, and Crisis and Command: A History of Executive Power from George Washington to George Bush.

The Honorable Juan Zarate is the global co-managing partner and chief strategy officer for the global consulting firm, K2 Integrity. He is also the co-founder and Chair of the Board of Consilient, an innovative new fintech.

He is the chairman and co-founder of the Center on Economic and Financial Power (CEFP) at the Foundation for Defense of Democracies, senior adviser at the Center for Strategic and International Studies(CSIS), and a senior fellow at West Point’s Combating Terrorism Center. He was a visiting lecturer in law at the Harvard Law School for eight years and is a published author, including his books “Treasury’s War” (2013) and “Forging Democracy” (1994).

Mr. Zarate served as the deputy assistant to the president and deputy national security adviser for combating terrorism (“counterterrorism czar”) from 2005 to 2009, where he was responsible for developing and implementing the U.S. counterterrorism strategy and policies related to transnational security threats, including hostage-taking, piracy, anti-money laundering, kleptocracy, transnational organized crime, and international energy infrastructure protection,. He was responsible for conceiving and leading major initiatives in the post 9/11 period, including the establishment of the Global Initiative to Combat Nuclear Terrorism (GICNT).

He was the first ever assistant secretary of the treasury for terrorist financing and financial crimes. In this role, he led the post-9/11 anti-money laundering and sanctions regime expansion in the United States; helped develop the international standards for AML/CFT and proliferation finance; supervised the Financial Crimes Enforcement Network (FINCEN), the Office of Foreign Assets Control (OFAC), and the Treasury’s Executive Office for Asset Forfeiture (TEOAF); drove the innovative use of the Treasury’s national security–related powers and ultimately the establishment of the Office of Terrorism and Financial Intelligence (TFI). He has also led some of the largest asset recovery ventures in history, including the return of over $3 billion in Iraqi assets.

Mr. Zarate is a former federal terrorism prosecutor, prior to 9/11, serving on the prosecution teams in the East Africa bombings and USS Cole cases, among others. He is a magna cum laude graduate of Harvard College, a cum laude graduate of the Harvard Law School, and a Rotary Fellow at the Universidad de Salamanca. At Harvard College, he won the John P. Reardon Award, as the best male student athlete.

Eric Grannon

Partner, White & Case

Biography

Mr. Grannon helps clients with antitrust matters, including civil and criminal defense as well as counseling for mergers and acquisitions and settlements of pharmaceutical patent litigation. Since 2001, he also has helped clients with concerns under the Foreign Corrupt Practices Act (FCPA) and other anti-corruption issues. Mr. Grannon began at the firm as a summer associate in 1997 and has been a partner since 2007.

A former prosecutor, Mr. Grannon returned to White & Case after serving as Counsel to the Assistant Attorney General in charge of the Antitrust Division of the United States Department of Justice (DOJ) in 2003-04, where he helped formulate US antitrust enforcement policy and manage the civil and criminal investigations and court cases brought by the Antitrust Division. He ended his DOJ service with a detail as a Special Assistant US Attorney in the District of Columbia, trying twenty bench and jury trials as lead counsel.

In private practice, Mr. Grannon has argued on behalf of clients in district courts across the country, including a successful verdict for defendants in an antitrust jury trial, argued appeals in the Eleventh and DC Circuits, and worked on eleven matters before the US Supreme Court, ten of which were antitrust cases.

Mr. Grannon clerked for the Honorable Walter K. Stapleton, US Court of Appeals for the Third Circuit, 1999-2000, and the Honorable Federico A. Moreno, US District Court for the Southern District of Florida, 1998-99.

He is a member of the Legal Policy Board of the Washington Legal Foundation.

Mr. Grannon served a three-year term, 2015-18, on the American Bar Association's Standing Committee on Amicus Curiae Briefs.

He previously served as Vice-Chair of the Health Care and Pharmaceuticals Committee of the American Bar Association Section of Antitrust Law, and prior to that as Vice-Chair of its Compliance and Ethics Committee.

Mr. Grannon has served as an adjunct faculty member at the Howard University School of Law, where he taught a seminar on advanced antitrust law.

Douglas H. Ginsburg

Senior Judge, United States Court of Appeals, District of Columbia Circuit

Biography

Circuit Judge Douglas H. Ginsburg was appointed to the United States Court of Appeals for the District of Columbia in 1986. After receiving his B.S. from Cornell University in 1970, and his J.D. from the University of Chicago Law School in 1973, he clerked on the D.C. Circuit and for Justice Thurgood Marshall on the United States Supreme Court. Thereafter, Judge Ginsburg was a professor at the Harvard Law School, the Deputy Assistant and then Assistant Attorney General for the Antitrust Division of the Department of Justice, as well as the Administrator of the Office of Information and Regulatory Affairs in the Office of Management and Budget. Concurrent with his service as a federal judge, Judge Ginsburg has taught at the University of Chicago Law School and the New York University School of Law. Judge Ginsburg is currently a Professor of Law at the George Mason University and a visiting professor at University College London, Faculty of Laws.

Judge Ginsburg is the Chairman of the International Advisory Board of the Global Antitrust Institute at the Law and Economics Center of the George Mason University School of Law. He also serves on the Advisory Boards of: Competition Policy International; the Harvard Journal of Law and Public Policy; the Journal of Competition Law and Economics; the Journal of Law, Economics & Policy; the Supreme Court Economic Review; the University of Chicago Law Review; the New York University Journal of Law and Liberty; and, at University College London, both the Centre for Law, Economics and Society and the Jevons Institute for Competition Law and Economics.

In 2020, Judge Ginsburg was the 11th recipient of the John Sherman Award, presented by the Antitrust Division of the Department of Justice in recognition of the awardee’s Lifetime Contributions to Antitrust Law and Policy.

In 2014, Judge Ginsburg received the Lifetime Achievement Award given annually by the Global Competition Review.

Noah Joshua Phillips

Biography

Noah Joshua Phillips is Co-Chair of the Antitrust Practice and previously served as a Commissioner of the Federal Trade Commission. He advises clients on a range of antitrust issues, including mergers and acquisitions, business conduct and compliance, litigation and investigations, and data security and privacy.

On the FTC, Mr. Phillips played an integral role in precedent setting enforcement actions and regulatory efforts concerning antitrust, consumer protection and privacy. He decided dozens of merger and other antitrust enforcement matters across the economy, including in the consumer product, defense, energy, entertainment, healthcare, technology, pharmaceutical and retail industries. Mr. Phillips’ written antitrust opinions were consistently upheld by federal appellate courts.

As Commissioner, Mr. Phillips frequently testified before Congress and represented the FTC before international bodies, including the G7, the Competition Committee of the Organisation for Economic Co-operation and Development, and the International Conference of Data Protection and Privacy Commissioners. He speaks and writes frequently on a range of antitrust, consumer protection and privacy issues.

Prior to the FTC, Mr. Phillips served as Chief Counsel to U.S. Senator John Cornyn, of Texas, on the Senate Judiciary Committee. He advised Senator Cornyn on a variety of legal and policy issues, as well as judicial nominations.

Mr. Phillips received an A.B. magna cum laude from Dartmouth College in 2000 and a J.D. from Stanford Law School in 2005. He began his career at a New York-based investment bank. After law school, Mr. Phillips clerked for Hon. Edward C. Prado of the U.S. Court of Appeals for the Fifth Circuit and joined Cravath’s Litigation Department in 2006. He left the Firm in 2010, and he rejoined Cravath as a partner in December 2022.
