The Ministerial Exception: Hosanna-Tabor v. EEOCEarlier this year the Supreme Court decided Hosanna-Tabor Evangelical Lutheran Church and School v. Equal Employment Opportunity Commission concerning the ministerial exception. The Court unanimously held that the Establishment and Free Exercise Clauses create a ministerial exception that requires dismissal of the plaintiff’s employment discrimination suit against her religious employer.
