Matt Festa teaches and researches in the areas of property law and land use, state & local government, energy & environmental law, trusts & estates, legal history, and national security law. His scholarship focuses on the relation between property rights and public control in land use planning and government regulation; on the role of property rights in constitutional law and history; and on property and the rule of law in contemporary international affairs.
Professor Festa joined the South Texas College of Law Houston faculty in 2007, after serving as a visiting assistant professor at the University of Georgia School of Law. Prior to teaching, he practiced in litigation, land use, environmental, and energy law at Locke Lord LLP. He served as a law clerk to federal judges on the U.S. District Court for the Eastern District of Kentucky and the U.S. Court of Appeals for the Sixth Circuit. Prof. Festa attended Vanderbilt University, where he was the Executive Editor of the Vanderbilt Law Review and earned a masters’ degree in history. Prior to law school he served in the U.S. Army’s 101st Airborne Division, and earned a masters’ degree in public administration. He earned his undergraduate degree in history and English at the University of Notre Dame.
Professor Festa currently serves as a judge advocate in the U.S. Army Reserve, where he is an Adjunct Professor in the Department of International & Operational Law at the ABA-accredited Judge Advocate General’s Legal Center and School, and is also an Instructor with the Defense Institute of International Legal Studies. Bert Ely has specialized in deposit insurance and banking structure issues since 1981. In 1986, he became an early predictor of the S&L crisis and a taxpayer bailout of the FSLIC. In 1991, he was the first person to correctly predict the non-crisis in commercial banking; in 1992, he predicted an eventual taxpayer bailout of the Japanese banking system.
Bert continuously monitors conditions in the banking and S&L industries, monetary policy, and the growing federalization of credit risk. He has helped to draft legislation to enact the cross-guarantee concept for privatizing banking regulation and its related deposit insurance and systemic risks. He has testified on numerous occasions before congressional committees on banking issues and he often speaks on these matters to bankers and others.

Before that, he was the chief financial officer of a public company, a consultant with Touche, Ross & Company, and an auditor with Ernst & Ernst. Circuit Judge Douglas H. Ginsburg was appointed to the United States Court of Appeals for the District of Columbia in 1986. After receiving his B.S. from Cornell University in 1970, and his J.D. from the University of Chicago Law School in 1973, he clerked on the D.C. Circuit and for Justice Thurgood Marshall on the United States Supreme Court. Thereafter, Judge Ginsburg was a professor at the Harvard Law School, the Deputy Assistant and then Assistant Attorney General for the Antitrust Division of the Department of Justice, as well as the Administrator of the Office of Information and Regulatory Affairs in the Office of Management and Budget. Concurrent with his service as a federal judge, Judge Ginsburg has taught at the University of Chicago Law School and the New York University School of Law. Alex J. Pollock is a Senior Fellow with the Mises Institute, providing thought and policy leadership on financial issues and the study of financial systems. His work includes cycles of booms and busts, financial crises with their political responses, housing finance, government-sponsored enterprises, risk and uncertainty, central banking, banking and financial regulation, corporate governance, retirement finance, student loans, and the politics of finance.
He previously served as the Principal Deputy Director of the Office of Financial Research in the U.S. Treasury Department 2019-2021. He was a Distinguished Senior Fellow with the R Street Institute 2015-2019 and 2021, and a resident fellow at the American Enterprise Institute, 2004-2015. Among the many aspects of his AEI work, he developed the One Page Mortgage Form to give borrowers in clear form the key information they need in order to know what they are committing themselves to. He was President and CEO of the Federal Home Loan Bank of Chicago from 1991 to 2004. There he invented the Mortgage Partnership Finance program, which successfully created front-end mortgage credit risk sharing beginning in 1997. His decades of banking experience include being a Visiting Scholar at the Federal Reserve Bank of St. Louis, 1991.

Peter J. Wallison holds the Arthur F. Burns Chair in Financial Policy Studies and is co-director of AEI’s program on Financial Policy Studies. Prior to joining AEI, he practiced banking, corporate and financial law at Gibson, Dunn & Crutcher in Washington, D.C., and New York. Mr. Wallison has held a number of government positions. From June 1981 to January 1985, he was General Counsel of the United States Treasury Department, where he had a significant role in the development of the Reagan Administration's proposals for deregulation in the financial services industry. During 1986 and 1987, Mr. Wallison was White House counsel to President Ronald Reagan, and between 1972 and 1976, he served first as Special Assistant to New York's Gov. Nelson A. Rockefeller and, subsequently, as counsel to Mr. Rockefeller as vice president of the United States.
Mr. Wallison was admitted to practice before the courts of New York and the District of Columbia, and is retired from practice in New York. Bert Ely has specialized in deposit insurance and banking structure issues since 1981. In 1986, he became an early predictor of the S&L crisis and a taxpayer bailout of the FSLIC. In 1991, he was the first person to correctly predict the non-crisis in commercial banking; in 1992, he predicted an eventual taxpayer bailout of the Japanese banking system.
Bert continuously monitors conditions in the banking and S&L industries, monetary policy, and the growing federalization of credit risk. Professor Engel is a national authority on mortgage finance and regulation, subprime and predatory lending, and housing discrimination. Her many publications, some of which she wrote with her frequent co-author, Professor Patricia McCoy, include articles in Texas Law Review, Fordham Law Review, Washington University Law Quarterly, Connecticut Law Review, and Housing Policy Debate. Professor Engel presents her research in academic, banking, and policy forums throughout the country and around the world. Her analysis of financial services markets and the laws that regulate them regularly catches the attention of the press; Business Week, The Economist, and The Wall Street Journal have all cited her work. In addition, her research has garnered her both University and national awards.
Professor Engel is an honors graduate from Smith College and the University of Texas School of Law. Following graduation from law school, Professor Engel clerked for Judge Homer Thornberry of the Fifth Circuit Court of Appeals in Austin, Texas. She then practiced law at Burnham & Hines in Boston, where she primarily represented plaintiffs in civil rights, and housing and employment discrimination cases. Prior to joining the faculty at Cleveland-Marshall College of Law, Professor Engel taught at Northeastern University and Case Western Reserve University.
Professor Engel serves as referee for several academic journals, and is a member of the Consumer Advisory Council of the Federal Reserve Board of Governors, the Executive Committee of the AALS Section on Financial Institutions and Consumer Financial Services, the Board of Directors of Americans for Fairness in Lending, and the Board of Advisors of the American Constitution Society for Law and Policy (Northeast Ohio Chapter).
