The Nondelegation Doctrine’s Next Good Year? SCOTUS Hears Oral Arguments in FCC v. Consumers’ Research

In Spring 2025, Mr. McCotter argued two related U.S. Supreme Court cases asking the Justices to enforce the Constitution’s requirement that Congress impose meaningful limits on how much power bureaucratic federal agencies can exercise—commonly referred to as the “nondelegation doctrine.” Until Mr. McCotter prevailed before the en banc Fifth Circuit below, it had been 90 years since an appellate court held a government program violated the nondelegation doctrine. Mr. McCotter is a partner with Boyden Gray PLLC in Washington DC and leads its administrative-law practice. He previously served as Deputy Associate Attorney General of the United States. He is a graduate of the University of North Carolina at Chapel Hill and the University of North Carolina School of Law.
