The subject of this debate: what will be the impact of the 2008 presidential election on the Supreme Court, the lower federal courts, and the direction of federal jurisprudence? Douglas Kmiec holds the endowed chair in constitutional law at Pepperdine Law School. Before entering the academy, Professor Kmiec was Assistant Attorney General, Office of Legal Counsel, in the administrations of Presidents Reagan and George H.W. Bush. Professor Kmiec has surprised legal conservatives by endorsing Sen. Obama in this year's presidential campaign. His book, Can A Catholic Support Him?: Asking the Big Questions About Barack Obama, was
published on September 15, 2008.

Richard Garnett teaches constitutional law at Notre Dame Law School. Before entering the academy, Professor Garnett clerked for Chief Justice William H. Rehnquist and Judge Richard S. Arnold of the U.S. Court of Appeals for the Eighth Circuit.

Judge Thomas Hardiman sits on the U.S. Court of Appeals for the Third Circuit.
