Jonathan H. Adler is the Johan Verheij Memorial Professor of Law and Director of the Center for Business Law & Regulation at the Case Western Reserve University School of Law. He and economist Michael Cannon largely developed the legal theory driving the Halbig/King cases. Prior to joining the faculty at Case Western, Adler clerked for the Honorable David B. Sentelle on the U.S. Court of Appeals for the District of Columbia Circuit.

The Affordable Care Act authorizes federal subsidies for health coverage obtained on an Exchange established by States. To date, only sixteen states have established Exchanges. In Halbig, King and other cases that may be headed to the Supreme Court, federal appeals courts are considering whether the IRS properly extended the subsidies to health coverage obtained on Exchanges established instead by the federal government. The cases involve interesting questions relating to statutory interpretation, federalism, administrative law and legislative supremacy.
