"Alabama’s Litigation Against The EPA’s Waters Of The United States Rule: A Case Study In Combating Federal Overreach In The Obama Era”

In 2015, the EPA finalized a rule to expand the jurisdictional limits of the Clean Water Act by defining the “Waters of the United States.” The US Chamber of Commerce explained that the rule “would significantly broaden federal regulatory jurisdiction over private activities on land and in waterways, wetlands and drainage ditches, and fundamentally change the scope and extent of long-standing state delegated Clean Water Act programs.”  The American Farm Bureau called the Rule “unwise, extreme and unlawful.”  The House of Representatives voted to repeal the rule.  After more than half of the States in the country sued to enjoin the rule, the rule was stayed by the Sixth Circuit Court of Appeals.  The Trump Administration has announced that it will reconsider the rule.  Brasher will discuss the background of the rule, the legal arguments against the rule, and the future of the litigation in light of the Trump Administration’s announcement.
