The recent high-profile controversy about the continuing—now 13 years—conservatorship over Britany Spears has been covered by everyone from US Weekly to the New Yorker to multiple law reviews and journals. Is the court’s power to take away individual decision-making in that case typical? How do Arizona courts exercise power over adults’ individual autonomy outside the criminal context, particularly in Probate, Mental Health, and Family Courts? What issues should a group of people who “believe and trust that individual citizens can make the best choices for themselves and society” be focused on when examining the exercise of these paternalistic powers?
