The existing environmental regulatory architecture, largely erected in the 1970s, is often criticized as being outdated and ill-suited to address contemporary environmental concerns. Adler argues that regulatory measures designed to address the industrial pollution of the twentieth century are not equipped to address the more complex challenges of the modern era. Adler will address ways that legal and policy constructs politically acceptable to conservatives—like private property rights, decentralized regulatory approaches, and competition-based approaches to environmentalism—could be brought to bear to address environmental concerns.
Professor Adler is the inaugural Johan Verheij Memorial Professor of Law and Director of the Center for Business Law & Regulation at the Case Western Reserve University School of Law, where he teaches courses in environmental, administrative and constitutional law. Adler is the author or editor of five books and over a dozen book chapters. His articles have appeared in publications ranging from the Harvard Environmental Law Review to The Wall Street Journal. His newest book, Business & The Roberts Court, will be released in July by Oxford University Press.
