Last month the U.S. Supreme Court heard oral arguments in Noel Canning v. NLRB, which considers the validity of President Obama's appointments to the National Labor Relations Board that occurred during an intra-session recess of less than three days. The D.C. Circuit concluded that these appointments were unconstitutional, casting into doubt many previous recess appointments. Noel Canning presents a constitutional question of first impression with substantial implications for the separation of powers and the balance of power between the Senate and the President. Come and hear a vigorous discussion with two noted constitutional scholars, Professor John Baker, Jr. and Professor Mark Kende, about what promises to be perhaps one of the most significant cases of this Supreme Court Term.
