Description

Federal District Court Judges are often the first line of defense for constitutional principles. Judges must consider and make decisions on novel legal theories concerning constitutional questions that bear on all sorts of controversial criminal and civil matters. These judges must also create records of their factual and legal findings on these controversial issues that will withstand appeal.  In this panel, the judges will discuss their approaches to dealing with difficult constitutional questions and give advice on how parties appearing before them can be effective advocates.

Considering how few cases are actually considered by the United States Supreme Court, the Federal Circuit Courts have an outsized influence on deciding important constitutional questions. In this panel, the judges will discuss their review of such questions and their decision-making process as they consider legal briefing and oral arguments. These judges will also discuss their unique role in the intermediate federal appellate courts between trial courts and the United States Supreme Court and address divisions between Circuits on important constitutional questions.

Description

Arguing constitutional principles before federal courts at all levels can be both an art and a science. Advocates must consider client needs, the legal consequences of an appeal, and the overarching effects of judicial decisions. These advocates must also consider strategies to make sure their arguments are heard in the most ideal forum and to make sure their advocacy is appropriately targeted to the judicial decision-makers. These panelists will discuss their own experiences in advocacy on important constitutional matters and share their best strategies on making sure their best arguments are heard.
