On May 27, 2008 the Supreme Court decided two employee discrimination retaliation cases: CBOCS West, Inc. v. Humphries and Gomez-Perez v. Potter. In CBOCS, the Court held that 42 USC 1981 encompasses an employee’s claim of retaliation for having complained of a race-based violation of a right protected by that statute. In Gomez-Perez the Court held that Section 633a(a) of the Age Discrimination in Employment Act (ADEA) prohibits retaliation against a federal employee who complains of age discrimination.  In this episode of SCOTUScast, Rae Vann, General Counsel for the Equal Employment Advisory Council discusses these two cases.
