On November 30, 2009, the Supreme Court heard oral argument in Merck v. Reynolds. The issue in this case is whether in a securities fraud case based on alleged material misstatements, an investor plaintiff must have evidence of scienter, or something short of that, before the statute of limitations starts to run.
