Professor Funk is the author of American Constitutional Structure and a co-author of one of the leading administrative law casebooks, Administrative Procedure and Practice: Problems and Cases, as well as Administrative Law: Examples & Explanations and the Federal Administrative Procedure Sourcebook. Together with Professor Craig Johnston, Professor Funk is also a co-author of Legal Protection of the Environment, an environmental law casebook. In 2004-05, Funk was a Senior Fulbright Scholar at the University of Heidelberg, where he taught both American constitutional law and environmental law. Before coming to the law school to teach, Professor Funk was an assistant general counsel at the U.S. Department of Energy and earned a special citation for exceptional performance from the Secretary of Energy. Prior to that Funk served as the principal staff member of the Legislation Subcommittee of the U.S. House of Representatives Permanent Select Committee on Intelligence, where he was instrumental in the drafting of the Foreign Intelligence Surveillance Act. Before joining the House Committee, Funk was a staff attorney in the Office of Legal Counsel of the U.S. Department of Justice, where he received a special commendation for outstanding service. Damien Schiff is a senior attorney at Pacific Legal Foundation. He leads its environmental practice group, a unique initiative that draws broadly from PLF’s expertise and success in property rights and separation of powers litigation. Over the years, Damien has represented hundreds of landowners and property rights advocates to defend their liberties against heavy-handed and unwarranted environmental and land-use regulation. His litigation experience includes Sackett v. U.S. Environmental Protection Agency, a groundbreaking decision in which the U.S. Supreme Court upheld the right of landowners to challenge Clean Water Act compliance orders issued by EPA, and Contoski v. Norton, PLF’s successful effort to force the federal government to make good on its promise to delist the bald eagle from the Endangered Species Act.
Besides litigation, Damien has written academic articles on a variety of subjects, including the Endangered Species Act, the Clean Water Act, greenhouse gas torts, the duty to rescue, and international water law. He has appeared on a variety of television and radio programs and has been quoted in The New York Times, The Wall Street Journal, Harper’s Magazine, and The Economist, among other publications.
He obtained his law degree magna cum laude from the University of San Diego School of Law, and his undergraduate degree magna cum laude from Georgetown University. While at USD, he was a research assistant for Professor Bernard Siegan, a leading constitutional theorist and advocate for property rights and economic liberty. Immediately prior to joining PLF, Damien clerked for Judge (and former PLF attorney) Victor Wolski of the United States Court of Federal Claims. Caleb Kruckenberg is CIR’s Litigation Director.
Caleb previously worked as a prosecutor, a public defender, a lobbyist for a national advocacy organization and, most recently, an impact litigator protecting the separation of powers at both the Pacific Legal Foundation and the New Civil Liberties Alliance. He has won major victories against numerous federal agencies, including the U.S. Department of Justice, Department of Labor, Bureau of Alcohol Tobacco and Firearms, and the Securities and Exchange Commission. He is also proud to have sued every U.S. attorney general, eight so far, since he has been litigating against the government on behalf of liberty-minded clients. Caleb has also argued more than 20 times in the U.S. Courts of Appeals, winning cases in 8 of the 12 regional circuit courts.
He graduated cum laude from Temple University Beasley School of Law in Philadelphia, where he was the lead articles editor for the Temple Law Review. Caleb also attended the Pennsylvania Academy of the Fine Arts, where he studied figurative painting.

Keith E. Sonderling was confirmed by the U.S. Senate on March 12, 2025 to be the 38th United States Deputy Secretary of Labor.
As the United States Deputy Secretary of Labor, Sonderling is the second-highest-ranking official and serves as the Department's Chief Operating Officer, overseeing the agency’s $14 billion dollar budget and 16,000 employees. The Deputy Secretary oversees key operational functions such as: strategic planning; budget formulation; financial management; information technology; and human resource management. Additionally, the Deputy Secretary provides the leadership and management of DOL’s agencies necessary to support the Secretary and the Department’s mission.

Dean Todd Clark is Dean of Delaware Law School. He joins Delaware Law School after serving as Associate Dean of Academic Affairs & Professor of Law at St. Thomas University Benjamin L. Crump College of Law. Before St. Thomas, Dean Clark was Professor of Law at North Carolina Central University School of Law where he taught Business Associations, Contracts, Corporate Justice, Employment Discrimination, and Hip Hop, Law & Justice. At NCCU, he also served on the ABA Compliance team and was the Director of the Justice in the Practice of Law Certificate Program and the Director of New Initiatives. Before that, Dean Clark was a Lecturer in Law at West Virginia University College of Law, where he taught Legal Writing and Appellate Advocacy.
Dean Clark earned his B.A. in Political Science from Wittenberg University, his M.B.A. from West Virginia University College of Business and Economics, and his J.D. from University of Pittsburgh School of Law. Deputy Officer for Civil Rights and Civil Liberties & Director of Equal Employment Opportunity and Diversity, Department of Homeland Security (DHS)
Veronica Venture is the Deputy Officer for Civil Rights and Civil Liberties and the Director of Equal Employment Opportunity and Diversity at the Department of Homeland Security (DHS). In this role, Ms. Venture leads the Department's EEO and diversity programs and initiatives. She also served as the Acting Officer for Civil Rights and Civil Liberties from January 2017 to September 2017.
Ms. Venture has brought significant expertise and experience with the federal EEO process and diversity management to DHS—particularly as it relates to law enforcement, having served at the Federal Bureau of Investigation for nine years before joining the Department. Prior to that, she began her career as a law clerk with the Equal Employment Opportunity Commission, and subsequently held positions as a Trial Attorney, Administrative Judge, Acting Area Director of the San Diego Field Office, Special Assistant to the Chair, and finally, as EEO Director. Ms. Venture received her BA from Connecticut College, and her JD from the Washington College of Law at American University in Washington, DC.

Devon Westhill is the Assistant Secretary for Civil Rights at the U.S. Department of Agriculture. The U.S. Senate confirmed President Donald Trump’s nomination of Westhill on October 7, 2025.
Westhill returns to the USDA where he previously headed the civil rights office as Deputy Assistant Secretary in President Trump’s first term. His previous government appointments also include service at the U.S. Department of Labor, liaison to the Administrative Conference of the U.S., and liaison to the White House Initiative on Historically Black Colleges and Universities. Prior to returning to government service, Westhill was President and General Counsel of a nonprofit civil rights organization.
Westhill has testified on civil rights matters before Congress, federal agencies, and as an expert witness in federal court. He has spoken hundreds of times at college campuses, conferences, and on radio and TV programs, and he is frequently quoted in print publications, and his writing has appeared in numerous national outlets. A U.S. Navy veteran, Westhill earned his BA from the University of North Carolina at Chapel Hill and his JD from the University of Florida.

Curt Levey is President of the Committee For Justice, an organization devoted to advancing constitutionally limited government and individual liberty. He is a veteran of Supreme Court and other judicial confirmation battles and serves on the executive committee of the Federalist Society's Civil Rights Practice Group.
After graduating Harvard Law School with honors and clerking for the U.S. Court of Appeals for the Sixth Circuit, Mr. Levey served as Director of Legal & Public Affairs at the Center for Individual Rights (CIR). There he worked on landmark Supreme Court cases, including the University of Michigan affirmative action cases and the successful constitutional challenge to the Violence Against Women Act. After CIR, Mr. Levey headed the Title IX policy group at the U.S. Department of Education.
Before attending law school, Mr. Levey earned an M.S. and B.A. in computer science from Brown University and worked in the field of artificial intelligence (AI). He invented a new type of AI technology, for which he wrote a successful patent application.

Hon. Kenneth L. Marcus is an internationally recognized expert in civil and human rights, as well as a leader in the fight against anti-Semitism on and off university campuses. He is the Founder, Chairman, and CEO of The Louis D. Brandeis Center for Human Rights Under Law, the leading civil rights legal organization fighting against anti-Semitism. Deputy Secretary of Labor, U.S. Department of Labor
Keith E. Sonderling was confirmed by the U.S. Senate on March 12, 2025 to be the 38th United States Deputy Secretary of Labor.
As the United States Deputy Secretary of Labor, Sonderling is the second-highest-ranking official and serves as the Department's Chief Operating Officer, overseeing the agency’s $14 billion dollar budget and 16,000 employees. The Deputy Secretary oversees key operational functions such as: strategic planning; budget formulation; financial management; information technology; and human resource management. Additionally, the Deputy Secretary provides the leadership and management of DOL’s agencies necessary to support the Secretary and the Department’s mission.
Prior to becoming Deputy Secretary, he was previously confirmed by the United States Senate to serve as the Commissioner of the U.S. Equal Employment Opportunity Commission (EEOC) from September 2020 until August 2024. He also served as the Commission’s Vice-Chair from 2020-2021.
During his tenure at the EEOC, one of Sonderling’s highest priorities was ensuring that artificial intelligence and workplace technologies are designed and deployed consistent with long-standing laws. He published numerous articles on the benefits and potential harms of using artificial intelligence-based technology in the workplace and spoke globally on artificial intelligence’s impact on the workplace.
Sonderling previously served at the US Department of Labor as the Acting and Deputy Administrator of the U.S. Department of Labor’s Wage and Hour Division from 2017-2020. During his tenure, the Division accomplished back-to-back record-breaking enforcement collections and educational outreach events. Sonderling also oversaw the development and publication of large-scale deregulatory rules and authored numerous Opinion Letters, Field Assistance Bulletins, and All Agency Memorandums. Additionally, he was instrumental in developing the Division’s first comprehensive self-audit program, which collected more than $7 million for nearly eleven thousand workers.
Before his government service, Sonderling was a partner at one of Florida’s oldest and largest law firms, Gunster. At Gunster, he counseled employers and litigated labor and employment disputes. In 2012, then-Governor Rick Scott appointed Sonderling to serve as the Chair of the Judicial Nominating Committee for appellate courts in South Florida. Sonderling was also active in the community, serving on the Board of Directors for Morse Life Health System, the Boca Raton Chamber of Commerce, and Leadership Florida.
Sonderling also serves as a Professional Lecturer in the Law (Adjunct Professor) at George Washington University Law School, teaching employment discrimination.
Sonderling received his B.S., magna cum laude, from the University of Florida and his J.D., magna cum laude, from Nova Southeastern University.
