In Learning Resources, Inc. v. Trump, SCOTUS rejected the Trump administration's reliance on the International Emergency Economic Powers Act to justify imposition of tariffs. The ruling was generally 6-3, but even a portion of Chief Justice Roberts' majority opinion garnered only three votes. Seven of the nine justices authored opinions in the case.
This event will grapple with what the court did--and what it didn't do--in the various opinions. And what doctrinal takeaways we can identify. The speakers will also weigh in on which justices may have charted a new path and which ones took positions consistent with past jurisprudence. The panel may also delve into the use and abuse of executive power in the imposition of tariffs.
