The next President may well have the opportunity to reshape the Supreme Court. Justice John Paul Stevens is 88 years old, and five other justices range in age from 69 to 75. What will the 2008 presidential election mean for the future of the Supreme Court? How would John McCain and Barack Obama differ in the sorts of candidates they would select for the Supreme Court? What prospects would their nominees face in the Senate's confirmation process? And how would their Supreme Court picks rule on hotly contested issues?

Mr. Whelan is president of the Ethics and Public Policy Center and directs EPPC's program on The Constitution, the Courts, and the Culture. He writes broadly on constitutional law and the judicial confirmation process, including as a regular contributor to National Review Online's Bench Memos blog. Mr. Whelan is a former law clerk to Supreme Court Justice Antonin Scalia, has served in positions of responsibility in all three branches of the federal government. Mr. Whelan served as the Principal Deputy Assistant Attorney General for the Office of Legal Counsel in the U.S. Department of Justice. In that capacity, he advised the White House Counsel's Office, the Attorney General and other senior DOJ officials, and Departments and agencies throughout the executive branch on difficult and sensitive legal questions. Mr. Whelan previously served on Capitol Hill as General Counsel to the U.S. Senate Committee on the Judiciary. In addition to clerking for Justice Scalia, he was a law clerk to Judge J. Clifford Wallace of the U.S Court of Appeals for the Ninth Circuit. He is a graduate of Harvard College and Harvard Law School.
