Clark Neily will discuss his new book, Terms of Engagement: How Our Courts Should Enforce the Constitution's Promise of Limited Government. Judicial engagement, Neily argues, calls for real judging in all constitutional cases, which means deciding cases based on actual facts and a genuine inquiry into the government's true ends -- the opposite of the ends-oriented, government-favoring type of review the Supreme Court applied in NFIB v. Sebelius, Kelo v. City of New London, and any rational basis case involving economic liberty, business regulations, tax policy, and property rights.
