Supreme Court Preview: What Is in Store for October Term 2026?

On October 1, 2026, the Federalist Society's Faculty Division and Practice Groups will host a panel at the Mayflower Hotel in Washington, DC, to preview the 2026 Supreme Court term, which will begin on October 5, 2026.
In its 2026–27 Term, the Supreme Court is poised to consider important disputes involving, among other issues, the Second Amendment, religious liberty, parental rights, election law, agency adjudication, and climate change litigation.
In this CLE program, our panel of experts will discuss some of the consequential cases on the Court’s docket, the implications of potential rulings for practitioners, and the broader doctrinal questions likely to shape this upcoming Term and beyond.
Featured cases include:
- Viramontes v. Cook County/Grant v. Higgins (a Second Amendment challenge to bans on AR-15-style rifles);
- St. Mary Catholic Parish v. Roy (a challenge to Colorado’s application of nondiscrimination requirements to religious schools within the state’s universal preschool program);
- Republican National Committee v. Mi Familia Vota (on whether the National Voter Registration Act or a federal consent decree displaces state documentary proof-of-citizenship requirements for voter registration);
- Suncor Energy (U.S.A.) Inc. v. County Commissioners of Boulder County (on whether federal law precludes state-law suits over the effects of greenhouse-gas emissions on the global climate);
- International Partners for Ethical Care, Inc. v. Ferguson (on whether parents have standing to challenge laws that displace their decisionmaking role concerning their children's gender transitions); and
- Department of Labor v. Sun Valley Orchards, LLC (on whether Article III permits the Department of Labor to adjudicate proceedings seeking monetary remedies for violations of H-2A employment requirements and whether federal law authorizes the Department to conduct those proceedings).
