State Courthouse Steps: Texas SB8 Litigation

In early March 2022, the Texas Supreme Court ruled that SB8 does not grant state-agency executives named as defendants any authoriy to enforce the act, directly or indirectly. The unanimous court emphasized that the law leaves civil litigation as the only enforcement mechanism. This ruling follows the U.S. Supreme Court's December 2021 ruling in Whole Woman's Health v. Jackson.
