Nominations: Where are President Trump and the Senate Taking the Courts?

Cincinnati Lawyers Chapter

Since President Reagan's nomination of Robert Bork to the U.S. Supreme Court, the federal court judicial nomination process seems to have grown more and more contentious and politicized with each passing year. In 2017, new milestones were met with the elimination of the filibuster for Supreme Court nominations, and the Senate’s use of blue slips has been scrutinized. President Donald Trump entered office facing a record number of federal judicial vacancies, but the Senate confirmed fewer judges in 2017 than was the case with most recent presidents. Is there a way forward? Where are the federal courts headed? Ilya Shapiro, Senior Fellow in Constitutional Studies at the Cato Institute and Editor-in-Chief of theCato Supreme Court Review, will share his thoughts on these issues.
