Dick Komer serves as a senior attorney at the Institute for Justice, where he litigates
school choice cases in state and federal courts.  Mr. Komer was lead counsel in Hart v. N.C. 
Dep’t of Public Instruction, a case upholding the constitutionality of a school choice program in 
North Carolina.  Last summer in the Hart case, the North Carolina Supreme Court ruled in favor 
of the Opportunity Scholarship Program which was enacted in 2013.  Several of Mr. Komer’s 
current cases involve the constitutionality of allowing school choice programs to include 
religious schools among the private schools that can participate.
 
Prior to joining the Institute of Justice, Mr. Komer worked as a career civil rights lawyer 
for the federal government, working at the Departments of Education and Justice, as well as the 
Equal Employment Opportunity Commission, first as special assistant to the Chairman, 
Clarence Thomas, and then as Director of the Office of Legal Counsel.  He ended his 
employment as Deputy Assistant Secretary for Civil Rights at the Department of Education.
