Jurisdiction Post-Daimler

Litigation Practice Group Teleforum

The 2014 Supreme Court decision Daimler v. Bauman focused on whether a California court has jurisdiction over a case involving a multinational company, with a subsidiary in California, being sued for conduct in Argentina. The Supreme Court unanimously ruled that an American company cannot be sued for conduct occurring outside the United States and that American courts do not have the jurisdiction to hear such cases.

After the decision, cases focusing on related jurisdictional issues have worked their way up to the Delaware Supreme Court, the Federal Circuit, New York, and others. This Teleforum will focus on issues that remain post-Daimler, such as whether registering to do business in a state alone can subject a business to general personal jurisdiction.
