The Commerce Clause (Article I, Section 8 of the Constitution), authorizes Congress "[t]o regulate Commerce...among the several States, ...." How broad is this federal authority? Where does the line between federal power and state and local prerogatives lie?

This Federalist Society debate probes the limits of the Commerce Clause by focusing on the U.S. Fish and Wildlife's listing of the Delta smelt under the Endangered Species Act, which has led to cutbacks in water for San Joaquin Valley farmers and urban communities in Central and Southern California. A constitutional challenge to the listing is now before the Ninth Circuit Court of Appeal. It contends that federal regulators have exceeded their Commerce Clause power because the Delta smelt exists only in one state - California - and is not an item in commerce.
