In recent years, the Iowa Supreme Court has taken a renewed interest in independently interpreting provisions of the Iowa Constitution. This has been seen in the area of criminal procedure protections, such as Article I, Section 8, which substantially mirrors the text of the Fourth Amendment to the U.S. Constitution, as was recently the subject of a divided opinion of the Court in State v. Pals, No. 09-0064 (Oct. 28, 2011). This raises interesting questions about how the Supreme Court should go about interpreting the state constitutional provision, the level of deference that should be afforded to U.S. Supreme Court decisions deciding the same or similar issues, and the practical implications for law enforcement attempting to conform their conduct to the law.
