Education Freedom: The Legal Landscape after Espinoza and Carson 
The Supreme Court has now held not only that the Establishment Clause permits use of vouchers at religious schools, but also that Free Exercise Clause precludes discrimination against religious education in choice programs. Even so, state education freedom initiatives face new challenges under state constitutions. This presentation will explore the history of school choice litigation at the Supreme Court, explain how opponents of education freedom continue to mount legal challenges to various choice programs, and describe the role of EdChoice Legal Advocates and Institute for Justice in defending those programs in court.
