Disparate impact is a theory under which a facially neutral policy or practice may be found to be discriminatory if it has a disproportionate adverse impact on a protected class. The theory makes discrimination cases easier to prove by reducing the need to prove discriminatory intent. For example, a landlord refusing to rent to people with a history of violent crime or poor credit histories could be sued for discrimination, despite the criteria being facially neutral, if the criteria had a disproportionate effect on a specific racial group. In January, the U.S. Supreme Court heard oral argument in Texas Dep’t of Housing and Community Affairs v. The Inclusive Communities Project, Inc., which addresses disparate impact in the Fair Housing Act. But disparate impact claims have also been raised in educational discrimination and other contexts.
Roger Clegg, the President and General Counsel of the Center for Equal Opportunity, focuses on legal issues arising from civil rights laws and has testified before Congress and litigated cases involving civil rights laws. Clegg has been active on issues of disparate impact for a number of years and will help us understand the arguments and implications.
Mr. Clegg has previously served as a Deputy Assistant Attorney General in the U.S. Department of Justice, with positions in both the Civil Rights Division and in the Environment and Natural Resources Division. He also has held several other positions at the U.S. Justice Department. Clegg is a graduate of Yale Law School.

Membership in the Federalist Society or the Cleveland Lawyers' Chapter is not required to attend our events.
