A “Winn” for School Choice: Implications of the Recent U.S. Supreme Court Case of Garriott v. Winn

In 1997, Arizona passed the Tuition Tax Credit Act, which gives state taxpayers a tax credit for contributions to private organizations that provide scholarships to students to attend the private school of their choice.  The measure—the first of its kind in the country—was challenged by the ACLU as a violation of the establishment clause of the First Amendment.  After more than 10 years of legal wrangling in the lower courts, the case was argued before the U.S. Supreme Court in November 2010 and a decision for the defendants was handed down by the Court on April 4, 2011.  Mr. Keller, co-counsel on behalf of the defendants, will discuss the Court’s decision and the implications for school choice programs being considered in various states, including North Carolina.
