Texas has long recognized that parents have a fundamental right to direct the upbringing, education, and health care of their children. But in Texas and beyond, there has often been tension between that right and the responsibility entrusted to governments to educate their youngest citizens. In recent years, many alternatives to the longstanding public education model have emerged and have been bolstered due to a variety of factors including the effects of COVID shutdowns, age-inappropriate books and curriculum, and dismal academic performance. As a result, parental empowerment has taken center stage in many states through the adoption of various school choice policies. How do these factors affect the trust in America’s educational system? How have recent cases applied the line between parental rights, government power, and free expression? How will school choice policies impact Texas?
