District Attorney’s Office v. Osborne
On June 18th, 2009, the Supreme Court announced its decision in District Attorney's Office v. Osborne. In this case, the Court considered whether Osborne had a due process right to access the evidence used against him in order to subject it to DNA testing. In a 5-4 decision delivered by Chief Justice Roberts, the Court held that "Osborne ha[d] no constitutional right to obtain postconviction access to the State’s evidence for DNA testing."
