ROGER MARTELLA co-leads the Environmental practice group at Sidley Austin LLP. He rejoined Sidley Austin LLP after serving as the General Counsel of the United States Environmental Protection Agency, concluding 10 years of litigating and handling complex environmental and natural resource matters at the Department of Justice and EPA. In 2015, Roger was recognized by Who’s Who Legal as the environmental lawyer of the year globally.
Roger’s practice focuses on three primary areas. First, Roger advises companies on developing strategic approaches to achieve their goals in light of rapidly developing demands to addressclimate change, promote sustainability and utilize clean energy. Second, Roger handles a broad range of environmental and natural resource litigation and mediation. Third, Roger advises multinational companies on compliance with environmental laws in the United States, China, the European Union and other nations.
Roger counsels approximately 50 of the world’s leading conventional and renewable energy, industrial, transportation, agricultural, forestry, and technology companies on bet-the-company environmental issues, regulatory matters, and litigation including transitioning to an era of legal controls addressing greenhouse gas emissions, increasingly stringent pollutant controls, alternative and clean energy, hydraulic fracturing, and sustainability both in the United States and abroad.
Roger employs a strategic, forward-looking approach to solving emerging law and policy issues across the world that have the potential to create both opportunities and risks for domestic and multinational energy and manufacturing companies and industries. Roger’s approach is to build a collaborative and coalition-building framework that seeks the strongest possible results through up front coordination with government, industry, and NGO stakeholders, leveraging strong honest broker relations with government officials and understanding of government approach to realize resolutions that have led to extraordinary favorable resolutions offering significant regulatory relief to industries and pennies-on-the-dollar enforcement settlements for companies.
Roger was unanimously confirmed by the United States Senate as EPA General Counsel. In that role, Roger served as EPA’s chief legal advisor supervising an office of 350 lawyers and staff in Washington and 10 regional offices. In particular, Roger led the team responsible for developing for the first time under the Clean Air Act the federal government’s climate change legal framework and options in response to the landmark Supreme Court decision Massachusetts v. EPA, which held greenhouse gases to be air pollutants under the Clean Air Act.
Judge, United States Court of Appeals, Fifth Circuit
James C. Ho is a Circuit Judge on the U.S. Court of Appeals for the Fifth Circuit. Before taking the bench on January 4, 2018, he was a partner and co-chair of the national Appellate and Constitutional Law practice group of Gibson, Dunn & Crutcher LLP.
As an appellate litigator for over a decade, including three years as the Solicitor General of Texas, Judge Ho presented 50 oral arguments in federal and state courts nationwide. He won numerous appeals, including three merits cases at the U.S. Supreme Court. He was routinely ranked among the nation’s leading lawyers by Benchmark, Chambers, Law360, The Legal 500, and The National Law Journal, among other publications. His work has been cited favorably by courts at every level of both the federal and state judiciaries. He won a Best Brief Award from the National Association of Attorneys General for every year that he served as solicitor general, and he is the only state solicitor general in history to be invited by the U.S. Supreme Court to express the views of a state.
Judge Ho has served in all three branches of the federal government. On the Senate Judiciary Committee, he served as chief counsel of the Subcommittees on the Constitution and Immigration under Senator John Cornyn. At the Justice Department, he served as Special Assistant to the Assistant Attorney General for Civil Rights and an attorney-advisor at the Office of Legal Counsel. He clerked for Judge Jerry E. Smith of the U.S. Court of Appeals for the Fifth Circuit and Justice Clarence Thomas of the U.S. Supreme Court.
His record of public service also includes appointments as vice chair of the Federal Judicial Evaluation Committee in Texas and co-chair of the National Asian Pacific American Bar Association Judiciary Committee, and as a member of the U.S. Magistrate Judge Merit Selection Panel for the Northern District of Texas, the U.S. delegation to the United Nations Committee on the Elimination of Racial Discrimination, and the Continuity of Government Commission.
In addition, Judge Ho has served as an Adjunct Professor of Law at the University of Texas School of Law, where he taught seminars on U.S. Supreme Court Litigation and Religious Liberty. He has authored numerous articles in respected law reviews nationwide, including an annual feature on exemplary judicial writing for The Green Bag Almanac & Reader. He previously served as senior editor of The Green Bag and as co-editor of Pub. L. Misc.
Judge Ho graduated from Stanford University with honors and a B.A. in Public Policy in 1995, and the University of Chicago Law School with high honors in 1999. Before law school, he was a legislative aide to California State Senator Quentin Kopp. He and his wife Allyson live in Dallas, Texas, with their twin daughter and son.

Rachel Brand is Walmart’s executive vice president of global governance, chief legal officer, and corporate secretary. She oversees the company’s global legal, compliance, ethics, corporate governance, digital citizenship, aviation, investigative, and corporate security functions, including Walmart’s Emergency Operations Center.
Immediately before joining Walmart, Rachel served as the United States Associate Attorney General and holds the distinction of being the first woman to serve in this role. She had previously served in the U.S. Department of Justice as the Assistant Attorney General for the Office of Legal Policy during President George W. Bush’s administration. Her other government service includes an appointment by President Obama to serve as a Member of the U.S. Privacy and Civil Liberties Oversight Board, service as an Associate Counsel to the President at the White House, and judicial clerkships with Justice Charles Fried of the Supreme Judicial Court of Massachusetts and Justice Anthony Kennedy at the Supreme Court of the United States. In the private sector, Rachel was a lawyer in private practice at two law firms in Washington, D.C. and served as the Vice President and Chief Counsel for Regulatory Litigation at the U.S. Chamber of Commerce Litigation Center.
Rachel serves on the board of directors for the Walmart Foundation and is the executive sponsor for Walmart’s Tribal Voices Associate Resource Group. Outside of Walmart, she serves on the board of directors for the International Justice Mission and is a member of The American Law Institute.
Rachel earned her Bachelor of Arts degree from the University of Minnesota-Morris and her J.D. from Harvard Law School.

James X. Dempsey is a Senior Counsel at CDT, working on Fourth Amendment issues, consumer privacy, and other topics. He has been with CDT since 1997, serving in a variety of roles, including as Executive Director from 2003 to 2005. In 2005, he established CDT West, in San Francisco. He coordinates the Digital Due Process coalition, a diverse group of companies, advocacy groups, and think tanks working to update the Electronic Communications Privacy Act of 1986. From 2001 to 2007, he led CDT’s Global Internet Policy Initiative (GIPI), which worked with government officials, industry and human rights organizations on Internet policy issues in developing and transitional countries.
Mr. Dempsey is the author or co-author of numerous articles in law reviews and other journals on privacy and Internet policy. He is co-author of the book Terrorism & the Constitution: Sacrificing Civil Liberties in the Name of National Security (New Press, Third edition, 2006) (with Prof. David Cole of Georgetown). He is widely quoted in the media and has testified numerous times before Congressional committees.
Mr. Dempsey began his career as an associate with the Washington, D.C. law firm of Arnold & Porter. From 1985 to 1995, he was assistant counsel to the House Judiciary Committee’s Subcommittee on Civil and Constitutional Rights. He worked on issues at the intersection of national security and constitutional rights, including terrorism, counter-intelligence, oversight of the Federal Bureau of Investigation, and electronic surveillance laws, as well as criminal justice issues. Prior to joining CDT, Jim was Deputy Director of the non-profit Center for National Security Studies and special counsel to the National Security Archive, a non-governmental organization that uses the Freedom of Information Act to gain the declassification of documents on U.S. foreign policy.
Mr. Dempsey is a graduate of Yale College (BA 1975) and Harvard Law School (JD 1979). He is a member of the bar of the District of Columbia.

Matthew R. A. Heiman joined the Company in May 2026 and has served as the Company’s Chief Legal Officer and Corporate Secretary since June 2026. Judge Katsas was appointed to the D.C. Circuit in December 2017. He graduated from Princeton University and Harvard Law School, where he was an executive editor on the Harvard Law Review. Between 1989 and 1992, he served as a law clerk to Judge Edward Becker on the Third Circuit, to then-Judge Clarence Thomas on the D.C. Circuit, and to Justice Thomas on the Supreme Court. Between 1992 and 2001, he was an associate and then partner in the Washington office of Jones Day, where he specialized in appellate and complex civil litigation. Between 2001 and 2009, he served in many senior positions in the Department of Justice, including as Assistant Attorney General for the Civil Division and as Acting Associate Attorney General. In 2009, he returned to Jones Day. From January to December 2017, he served as Deputy Assistant to the President and Deputy Counsel to the President.
Before joining the bench, Judge Katsas argued more than 75 appeals, including three cases in the Supreme Court, 13 cases in the D.C. Circuit, and cases in every other federal court of appeals. By appointment of the Chief Justice, he served on the Advisory Committee on Appellate Rules from 2013 to 2017. In 2016, he was elected to membership in the American Academy of Appellate Lawyers.
