Since the financial crisis, banks have been the target of extensive regulatory efforts. Yet regulators have taken measures against banks (and others) that appear to exceed statutory and constitutional limits.

Is the Orderly Liquidation Authority under the Dodd-Frank statute a measured response or does it set up a show trial regime? Is the Consumer Financial Protection Bureau really a superlegislature operating without accountability? And can the Department of Justice legitimately force banks to deny checking accounts to porn stars and pot clubs, as it is doing under Operation Choke Point?
