Senior Attorney, Institute for Justice
Paul Avelar is the Managing Attorney of the Institute for Justice Arizona Office. He joined the Institute in March 2010 and litigates free speech, property rights, economic liberty, school choice and other constitutional cases in federal and state courts.
As the head of IJ’s national Braiding Freedom Initiative, Paul represents natural hair braiders across the country to protect their right to earn an honest living. The Initiative uses lawsuits, activism and research to remove laws that require potential braiders to undergo hundreds of costly training hours just to braid hair. Since IJ launched the Braiding Freedom Initiative in 2014, 12 additional states have freed braiders from unnecessary licensing burdens. Paul drafted the model Natural Hair Braiding Protection Act, which has been adopted in Arkansas, Indiana, Iowa, Kentucky, Nebraska, New Hampshire, Texas and South Dakota. He is currently representing braiders in Missouri, where state laws infringe upon their right to earn an honest living.
In his free speech work, Paul has challenged numerous laws that trample First Amendment rights. In Arizona Freedom Club PAC v. Bennett, he represented candidates and independent groups in a successful U.S. Supreme Court challenge to the “matching funds” provision of Arizona’s publicly financed elections system. He represented grassroots groups and individuals in Arizona, Mississippi and Washington, where state laws burdened their political speech by requiring them to register with the government, to navigate complex regulations and to face fines and possible criminal penalties merely because they talked about political issues. In Washington, Paul protected a lawyer’s right to defend, pro-bono, the First Amendment rights of political speakers. Through litigation and legislation, Paul leads the fight against abusive civil forfeiture laws in Arizona and elsewhere.
Paul also co-authored the most comprehensive published study of economic liberty protections in the Arizona Constitution. The Chief Justice of the Arizona Supreme Court appointed Paul to the Task Force on the Review of the Role and Governance Structure of the State Bar of Arizona, where he dissented from the majority report and called on leaders to substantially reform the Bar and state regulation of the practice of law. He often speaks at law schools across the country about constitutional issues and his work at IJ.
Prior to joining IJ-AZ, Paul worked as an attorney in Philadelphia. He clerked for Judge Roger Miner on the 2nd U.S. Circuit Court of Appeals, Justice Andrew Hurwitz on the Arizona Supreme Court, and Judge Daniel Barker on the Arizona Court of Appeals.
Paul graduated manga cum laude from the Arizona State University College of Law in 2004 and was elected to the Order of the Coif. He received his undergraduate degree from Princeton University in 2000.

Braden H. Boucek serves as Director of Litigation at the Southeastern Legal Foundation (SLF). His cases at SLF focus on restoring constitutional balance, equal protection, the First Amendment, and property rights. He is an avid defender of America's Founding and a constitutional law professor. He has also actively litigated school choice cases.
Prior to joining SLF, he served as Vice President of Legal Affairs at the Beacon Center of Tennessee, where he worked on economic liberty, dedicated himself to Tennessee's unique constitutional rights, and protecting the free speech rights of professionals.
Braden has been a litigator since 2001. Previously, Braden was an Assistant U.S. Attorney in both Nashville and Memphis for over nine years. During that time, he handled hundreds of cases ranging from Organized Crime, Drug Trafficking, Fraud, Counterfeiting, Terrorism and Immigration offenses. Braden has been recognized by his office for performance, winning both the Special Achievement award and Distinguished Service award. Two of his investigations were recognized as the district’s “Case of the Year” by the Department of Justice’s Organized Crime and Drug Enforcement Task Force. For nearly five years before joining the Department of Justice, Braden served as a prosecutor for the State of Tennessee, first as an Assistant Attorney General and later as an Assistant District Attorney. He has been lead counsel in many jury trials at both the state and federal level. He has also argued dozens of cases before state and federal appellate courts, including the Tennessee Supreme Court and Sixth Circuit Court of Appeals. Braden also served as an extern for the Florida Supreme Court. He obtained his J.D. at Florida State University College of Law, and his B.A. at the University of Richmond.

Rick Herz is a 1993 Order of the Coif graduate of the University of Virginia School of Law, where he served on the Virginia Law Review. In 1994, he clerked for the Hon. Raymond A. Jackson, U.S. District Judge for the Eastern District of Virginia. Rick was the 1997-1998 Natural Resources Law Institute Fellow at Northwestern School of Law of Lewis and Clark College, where he wrote”Litigating Environmental Abuses Under the Alien Tort Claims Act: A Practical Assessment” , an article about suing multinational corporations for environmental abuses under the Alien Tort Claims Act. Lawrence O. Gostin is University Professor, Georgetown University’s highest academic rank conferred by the University President. Prof. Gostin directs the O’Neill Institute for National and Global Health Law and is the Founding O’Neill Chair in Global Health Law. He served as Associate Dean for Research at Georgetown Law from 2004 to 2008. He is Professor of Medicine at Georgetown University and Professor of Public Health at the Johns Hopkins University.
Prof. Gostin is the Director of the World Health Organization Collaborating Center on National and Global Health Law. The WHO Director-General has appointed Prof. Gostin to high-level positions, including the International Health Regulations (IHR) Roster of Experts and the Expert Advisory Panel on Mental Health. He served on the Director-General’s Advisory Committee on Reforming the World Health Organization, as well as numerous WHO expert advisory committees, including on the Pandemic Influenza Preparedness Framework, smallpox, genomic sequencing data, migrant health, and NCD prevention. He served on the WHO/Global Fund Blue Ribbon Expert Panel: The Equitable Access Initiative to develop a global health equity framework. He co-chairs the Lancet Commission on Global Health Law.
Professor Gostin served on two global commissions to report on the lessons learned from the 2015 West Africa Ebola epidemic. He was also senior advisor to the United Nations Secretary General’s post-Ebola Commission. He also served on the drafting team for the G-7 Summit in Tokyo 2016, focusing on global health security and Universal Health Coverage.
Prof. Gostin holds multiple international academic professorial appointments, including at Oxford University, the University of Witwatersrand (South Africa), and Melbourne University. Prof. Gostin served on the Governing Board of Directors of the Consortium of Universities for Global Health.
Prof. Gostin holds editorial appointments in leading academic journals throughout the world. He is the Legal and Global Health Correspondent for the Journal of the American Medical Association. He is also Founding Editor-in-Chief of Laws (an international open access law journal). He was formally the Editor-in-Chief of the Journal of Law, Medicine & Ethics.
Prof. Gostin holds four honorary degrees. In 1994, the Chancellor of the State University of New York conferred an Honorary Doctor of Laws Degree. In 2006, Her Majesty Queen Elizabeth II and the Vice Chancellor awarded Cardiff University’s (Wales) highest honor, an Honorary Fellow. In 2007, the Royal Institute of Public Health (United Kingdom) appointed Prof. Gostin as a Fellow of the Royal Society of Public Health (FRSPH). In 2012, the Chancellor of the University of Sydney – on the nomination of the Deans of the Law and Medical Schools – conferred a Doctor of Laws (honoris causa), presided by two Justices of Australia’s highest court—Justices Kirby and Haydon.
Prof. Gostin is an elected lifetime Member of the National Academy of Medicine/ National Academy of Sciences. He has served on the National Academy’s Board on Health Sciences Policy, the Board on Population Health, the Human Subjects Review Board, and the Committee on Science, Technology, and Law. He currently serves on the National Academies of Sciences Engineering, and Medicine, Board on Global Health. Gostin chaired the National Academy’s Committee on Global Solutions to Falsified, Substandard, and Counterfeit Medicines. He has chaired National Academy Committees on national preparedness for mass disasters, health informational privacy, public health genomics, and human subject research on prisoners.
Prof. Gostin is also a Member of the Council on Foreign Relations and Fellow of the Hastings Center. In 2016, President Obama appointed Prof. Gostin to a six-year term on the President’s National Cancer Advisory Board to advise the nation on cancer prevention, research, and policy. He also serves on the National Institutes of Health Director’s Advisory Committee on the ethics of public/private partnerships to end the opioid crisis.
Prof. Gostin has led major law reform initiatives in the U.S., including drafting the Model Emergency Health Powers Act (MEHPA) to combat bioterrorism (following the post-9/11 anthrax attacks) and the “Turning Point” Model State Public Health Act. He also spearheaded the World Health Organization and International Development Law Organization’s major report, Advancing the Right to Health: The Vital Role of Law.
Prof. Gostin’s proposal for a Framework Convention on Global Health – an international treaty ensuring the right to health – is now part of a global campaign, endorsed by the UN Secretary-General and Director of UNAIDS.
In the United Kingdom, Lawrence Gostin was the Legal Director of the National Association for Mental Health, Director of the National Council of Civil Liberties (the UK equivalent of the ACLU), and a Fellow at Oxford University. He helped draft the Mental Health Act (England and Wales) and brought landmark cases before the European Court of Human Rights.

David A. Hyman, M.D., J.D., is the Scott K. Ginsburg Professor of Health Law & Policy at Georgetown University. Professor Hyman focuses his research and writing on the regulation and financing of health care. He teaches or has taught health care regulation, civil procedure, insurance, medical malpractice, law & economics, professional responsibility, and tax policy.
While serving as Special Counsel to the Federal Trade Commission, Professor Hyman was principal author and project leader for the first joint report ever issued by the Federal Trade Commission and Department of Justice, “Improving Health Care: A Dose of Competition” (2004). Marc A. Levin is the Chief Policy Counsel for the Council on Criminal Justice (counciloncj.org) and Senior Advisor for Right on Crime.
An attorney and accomplished author on legal and public policy issues, Marc began the Foundation’s criminal justice program in 2005. This work contributed to nationally praised policy changes that have been followed by dramatic declines in crime and incarceration in Texas. Building on this success, in 2010, Levin developed the concept for the Right on Crime initiative, a TPPF project in partnership with Prison Fellowship and the American Conservative Union Foundation. Right on Crime has become the national clearinghouse for conservative criminal justice reforms and has contributed to the adoption of policies in dozens of states that fight crime, support victims, and protect taxpayers.

Marc has testified on criminal justice policy on four occasions before Congress and has testified before legislatures in states including Texas, Nevada, Kansas, Wisconsin, and California. Renée J. Mitchell served in the Sacramento Police Department for twenty-two years and is currently a Senior Police Researcher with RTI International. She holds a B.S. in Psychology, an M.A. in Counseling Psychology, an M.B.A., a J.D., and a Ph.D. in Criminology from the University of Cambridge. She was a 2009/2010 Fulbright Police Research Fellow where completed research in the area of juvenile gang violence at the London Metropolitan Police Service. His legal background and work experience as a practicing attorney have helped shape his unique approach to contract negotiations and ability to develop creative solutions. Kyle ensures that clients are prepared and informed, as he heads the company's study of contract analytics and maintains a comprehensive database of NFL contracts. He also takes pride in his knowledge of the NFL Collective Bargaining Agreement and devotes himself to providing candid advice and relentless advocacy. Kyle's work has resulted in over $500 million of playing contracts for NFL clients.
A native of Syracuse, New York, Kyle attended The Ohio State University, graduating with a Bachelor’s Degree in Political Science. He then received his Juris Doctor from the University of Chicago, where he served as President of the Sports and Entertainment Law Society.
He and his wife Allison reside in Lombard, Illinois, with their five children.

Before founding DM Legal Strategy, Dennis served as the General Counsel and Senior Advisor to Governor Rauner in Illinois, where he led a large team responsible for a wide range of legal, regulatory, and compliance issues in an organization with an annual budget of approximately $60 billion. He began his legal career as a federal appellate law clerk and then practiced appellate litigation at a large, international law firm. With over a decade of diverse experiences, Dennis loves the law and is constantly looking for creative ways to make sure his clients achieve business success no matter how complex a regulatory environment they face.

Rick Herz is a 1993 Order of the Coif graduate of the University of Virginia School of Law, where he served on the Virginia Law Review. In 1994, he clerked for the Hon. Raymond A. Rick was the 1997-1998 Natural Resources Law Institute Fellow at Northwestern School of Law of Lewis and Clark College, where he wrote”Litigating Environmental Abuses Under the Alien Tort Claims Act: A Practical Assessment” , an article about suing multinational corporations for environmental abuses under the Alien Tort Claims Act. Eliot, who is a native Spanish speaker, has in-depth knowledge of Latin American law and recently completed a term as the Senate-confirmed Executive Director of the Inter-American Development Bank (IDB), the largest source of development finance for Latin America and the Caribbean.
