Brian Fitzpatrick is the Milton R. Underwood Chair in Free Enterprise and Professor of Law at Vanderbilt Law School, where his research focuses on class action litigation, federal courts, judicial selection, and constitutional law. He is best known for his empirical studies of class action settlements as well as his book The Conservative Case for Class Actions (University of Chicago Press, 2019). Professor Fitzpatrick joined Vanderbilt's law faculty in 2007 after serving as the John M. Olin Fellow at New York University School of Law. He graduated first in his class from Harvard Law School and went on to clerk for Judge Diarmuid O'Scannlain on the U.S. Court of Appeals for the Ninth Circuit and Justice Antonin Scalia on the U.S. Supreme Court. After his clerkships, Professor Fitzpatrick practiced commercial and appellate litigation for several years at Sidley Austin in Washington, D.C., and served as Special Counsel for Supreme Court Nominations to U.S. Senator John Cornyn. Theodore H. Frank is director at the Hamilton Lincoln Law Institute and the Center for Class Action Fairness. Frank founded and ran CCAF as a non-profit, public interest law firm in 2009.

Frank has won several landmark appeals and tens of millions of dollars for consumers and other plaintiffs through his class action work. Scott served on the Attorney General's Advisory Committee, advising on national policy for the Department of Justice.

Scott previously served as head of litigation for a publicly traded Pittsburgh-based financial management company, where he helped lead its expansion into new markets in Asia and Europe. William M. McSwain

William M. (Bill) McSwain practices in the area of litigation with a focus on white-collar criminal matters, internal investigations and complex business litigation. Bill is the immediate past U.S. Attorney for the Eastern District of Pennsylvania (EDPA), which is one of the nation’s most populous districts, with nearly six million people residing within Philadelphia and its eight surrounding counties. As U.S. Attorney, he served as the chief federal law enforcement officer in the EDPA, responsible for all federal criminal prosecutions, investigations and civil litigation involving the United States. He supervised a staff of approximately 300, including more than 140 Assistant U.S. Attorneys, at offices in Philadelphia and Allentown, PA.

Most importantly, Bill is a fighter who knows how to win. For example, as U.S. Attorney, he personally served as lead counsel in United States v Safehouse, in which he challenged Philadelphia’s plan to be the first city in the country to open supervised heroin injection sites. He argued and won the case in the U.S. Court of Appeals for the Third Circuit, which ruled that such sites would violate the federal Controlled Substances Act.

A former U.S. Marine Corps infantry officer and scout/sniper platoon commander, Bill brings an aggressive and creative approach to private practice, representing clients involved in government investigations and high stakes litigation. In particular, he enjoys taking on the challenge of winning seemingly “impossible” cases. He has lived that mindset from the very outset of his legal career.

For example, prior to his service as U.S. Attorney, Bill took on the case of an Iranian immigrant, Ken Hamidi, who was locked in a battle with Intel over emails that Mr. Hamidi has sent to Intel employees. After Mr. Hamidi had lost his case in the trial and intermediate appellate courts with other counsel, Bill took over and argued the case in front of the Supreme Court of California. In Intel Corp. v. Hamidi, 30 Cal.4th 1342 (2003), he won a 4-3 decision that established the legal rules for trespass liability on the Internet, one of the most significant cyberlaw rulings in the United States. Soon thereafter, Bill represented Chester County, Pennsylvania in its dispute regarding the attempted removal of an historic Ten Commandments plaque hanging on the façade of the County Courthouse. After the County lost at trial with other counsel, Bill stepped in and argued the case in front of the U.S. Court of Appeals for the Third Circuit. In Chester County, PA v. Freethought Society, et al., 334 F.3d 247 (3d Cir. 2003), he won a 3-0 decision that preserved the plaque, which is hanging on the Courthouse to this day. In one of his most challenging assignments, Bill began representing the Boy Scouts in 2008 in its dispute with the City of Philadelphia. Facing eviction from its historic headquarters building, the Scouts sued the City, alleging a violation of their First Amendment rights. In Cradle of Liberty Council, Boy Scouts of America v. City of Philadelphia, No. 2:08-cv-02429-RB (E.D. Pa.), Bill won a nationally publicized, three-week jury trial, and even secured a court ruling that the City had to pay the Scouts’ attorney’s fees.

Bill understands that, in a very real sense, anybody or any organization squaring off against the government – especially against the federal government – is an underdog. Bill has a long record of success advocating for clients in those situations. For example, in United States v. Bruno, No. 2:13-cr-00039-LS-6 (E.D. Pa.), he represented a Pennsylvania judge against federal conspiracy, wire fraud and mail fraud charges and won a full acquittal after a two-month jury trial. In United States. v. Brown, No. 2:12-cr-00367-RBS-1 (E.D. Pa.), Bill represented a nationally renowned charter school educator who faced a massive 67-count indictment alleging conspiracy, wire fraud, obstruction of justice and witness tampering. After a two-month trial, the jury acquitted Bill’s client on several counts and deadlocked on the others. The government eventually withdrew all of the deadlocked charges.

His record in the courtroom notwithstanding, Bill is also a thoughtful, intellectually curious strategist who has resolved numerous contentious matters out of court on terms his clients found favorable. He is a graduate of Yale University (B.A., cum laude, 1991) and the Harvard Law School (J.D., 2000), where he was an editor of the Harvard Law Review, won the Ames Moot Court Competition and received the George Leisure Award as the Best Oralist in the Ames Competition. He is an adjunct lecturer in law at the University of Pennsylvania Law School. He began his legal career by clerking for the Hon. Marjorie O. Rendell, U.S. Circuit Judge of the U.S. Court of Appeals for the Third Circuit.

Natalie Mihalek

Biography

Natalie Mihalek is a member of the Pennsylvania House of Representatives. A native of Allegheny County, Natalie Mihalek’s commitment to public service began early. Immediately after high school graduation, she enlisted to serve in the US Navy and qualified to serve in the Navy’s elite nuclear power program. Her years spent in the engine room working on a nuclear power plant instilled in her a readiness for any situation that lay ahead.

Natalie returned to Pennsylvania after her service, earning her BA from the University of Pittsburgh and went on to earn a law degree from Appalachian School of Law. Her legal career began in the Allegheny County District Attorney’s Office where she served in the general trial division, prosecuting hundreds of cases in the Allegheny County Court of Common Pleas. She would spend the next 10 years in private practice with a focus on family law and criminal defense.

In 2018, suburban voters of Pittsburgh elected Natalie to the Pennsylvania House of Representatives. She quickly earned a reputation as a consensus builder focused on bringing good paying jobs to Pennsylvania and standing up for victims of crime.

Today, Natalie chairs the Southwest Delegation, the largest voting bloc in the General Assembly and a leading voice in conservative policy in the legislature.

Stephanos Bibas is a judge on the U.S. Court of Appeals for the Third Circuit. Judge Bibas was previously a professor of law and criminology at the University of Pennsylvania Law School. As director of the Penn Law Supreme Court Clinic, he argued six cases before the Supreme Court of the United States and filed briefs in dozens of others. He graduated summa cum laude and Phi Beta Kappa from Columbia University in 1989 with a B.A. in political theory and from Oxford University in 1991 with a B.A. in jurisprudence. He then earned his J.D. from Yale Law School in 1994.

After graduating from Yale Law, Judge Bibas clerked for Judge Patrick Higginbotham of the U.S. Court of Appeals for the Fifth Circuit and Justice Anthony Kennedy on the Supreme Court and was a litigation associate at Covington & Burling LLP in Washington, D.C. Thereafter, Judge Bibas served as an Assistant U.S. Attorney in the Southern District of New York, where he successfully prosecuted the world’s leading expert in Tiffany stained glass for hiring a grave robber to steal priceless Tiffany windows from cemeteries. Before his tenure at Penn Law, Judge Bibas taught at the University of Chicago Law School and the University of Iowa College of Law and was a research fellow at Yale Law School. Stephen F. Joshua Kleinfeld

Joshua Kleinfeld teaches and writes about political, legal, and moral philosophy, criminal law, and criminal procedure. He also practices law in Northwestern's Juvenile Criminal Defense Clinic. He is a full professor with tenure at the Northwestern Pritzker School of the Law and (by courtesy) in Northwestern’s philosophy department. In 2017-18, he was a visiting professor at Harvard and Stanford Law Schools. He is the recipient of the Bator Award, given annually to one American law professor under the age of 40 who has demonstrated "excellence in legal scholarship, a commitment to teaching, a concern for students, and who has made a significant public impact."

In philosophy, Kleinfeld's research focuses on the idea of "embodied ethical life," as developed in the socio-theoretic tradition of Hegel, Weber, and Durkheim. This tradition aims to understand and critique social life by bringing to light the normative ideas implicit in social practices and institutions. In law, this means that the most interesting philosophical concepts are often those reflected or actualized in legal practice – in the law as judges and lawyers think of it and wield it.

In criminal law and procedure, Kleinfeld has developed a theory known as "reconstructivism," which holds that the chief office of criminal law is not to dole out retributive justice, nor to optimize crime and cost control, but to reconstruct a violated normative order in the wake of a crime. This work, which draws on the thought of Hegel, Durkheim, Jean Hampton, and Antony Duff, develops an alternative to retributive and utilitarian theories of criminal law by focusing on the distinctive social function and sense of justice at work in the criminal system.

Kleinfeld is also involved in practical criminal justice reform. In this vein, he defends children accused of homicide in the Northwestern Juvenile Criminal Defense clinic and assists in litigation efforts meant to reform American criminal law through the courts. He has also developed a view of criminal justice reform known as "democratization," which holds that the root of the American criminal justice crisis is a set of bureaucratic attitudes, structures, and incentives divorced from the American public’s concerns and sense of justice, and that the primary solution is to make criminal justice more community-focused and responsive to lay influences. Working with others, he has developed a number of policy proposals meant to reform American criminal justice in a democratic direction.

Kleinfeld holds a JD from Yale Law School, a PhD in philosophy from the Goethe University of Frankfurt (supervised by Axel Honneth, Klaus Günther, and Rainer Forst), and a BA in philosophy from Yale College. He clerked for Judge J. Harvie Wilkinson on the United States Court of Appeals for the Fourth Circuit; Judge Janice Rogers Brown on the United States Court of Appeals for the D.C. Circuit; and President (chief justice) Aharon Barak of the Supreme Court of Israel. He worked as an Associate at Debevoise & Plimpton LLP in Frankfurt, Germany, in the area of corporate criminal law. Cappy, of the Pennsylvania Supreme Court. Judge Stickman returned to the practice of law as an associate, and later a partner, of the Pittsburgh litigation boutique firm of Del Sole Cavanaugh Stroyd LLC. In practice, Judge Stickman represented a diverse array of clients in state and federal trial and appellate courts throughout the United States.

In 2011 Judge Stickman was appointed by the Pennsylvania Supreme Court to serve on the Pennsylvania Civil Procedural Rules Committee—a panel of lawyers and judges charged with aiding the Court in reviewing and revising Pennsylvania’s unique Rules of Civil Procedure. The Court appointed Judge Stickman to be Chair of the Committee in 2015.

Judge Stickman is active in legal scholarship. He is the author of a peer-reviewed publication on the ancient King’s Bench Jurisdiction of the Pennsylvania Supreme Court. He has served as a frequent guest lecturer on topics relating to legal procedure and history.

Judge Stickman was nominated to serve as a Judge of the Western District of Pennsylvania on May 13, 2019. He was confirmed by the Senate on July 31, 2019, and received his commission on August 5, 2019.

Susan Dudley is the Founder and Director of the George Washington University Regulatory Studies Center, established in 2009 to raise awareness of regulations’ effects and improve regulatory policy through research, education, and outreach. She is also a distinguished professor of practice in the Trachtenberg School of Public Policy and Public Administration. She is past-president of the Society for Benefit Cost Analysis, a senior fellow of the Administrative Conference of the United States, and on the Regulatory Transparency Project Regulatory Practice Working Group. Her book, Regulation: A Primer, with Jerry Brito, is available on Amazon.com.

From April 2007 through January 2009, Professor Dudley served as the Presidentially-appointed Administrator of the Office of Information and Regulatory Affairs in the U.S. Office of Management and Budget and was responsible for the review of draft executive branch regulations under Executive Order 12866, the collection of federal-government-wide information under the Paperwork Reduction Act, the development and implementation of government-wide policies in the areas of information policy, privacy, and statistical policy, and international regulatory cooperation efforts.

Prior to OIRA, she directed the Regulatory Studies Program at the Mercatus Center at George Mason University, and taught courses on regulation at the George Mason University School of Law. Earlier in her career, Professor Dudley served as an economist at OIRA, as well as the Environmental Protection Agency and the Commodity Futures Trading Commission. She was also a consultant to government and private clients at Economists Incorporated. She holds a Master of Science degree from the Sloan School of Management at MIT and a Bachelor of Science degree (summa cum laude) in Resource Economics from the University of Massachusetts, Amherst.

Sally Katzen served in the Clinton administration as administrator of the Office of Information and Regulatory Affairs in the Office of Management and Budget (OMB), as deputy assistant to the president for economic policy and deputy director of the National Economic Council in the White House, and then as the deputy director for management at OMB. She served as the head of the Agency Review Group for the Obama/Biden transition with responsibility for the Executive Office of the President and all government-wide agencies. She has taught both undergraduates and at various law schools. She is a member of the American Law Institute and the National Academy of Public Administration, has served on multiple panels for the National Academy of Sciences, testified frequently before Congress, and is on the board of several non-profit organizations. Before joining the Clinton administration, Katzen was a partner in the Washington, DC, law firm of Wilmer, Cutler & Pickering, specializing in regulatory and legislative matters, while serving in leadership roles in the American Bar Association (including chair of the Section on Administrative Law and Regulatory Practice and as DC delegate to the ABA’s House of Delegates), as president of the Federal Communications Bar Association and as president of the Women’s Legal Defense Fund. She graduated from Smith College and the University of Michigan Law School, where she was the first woman editor-in-chief of the Law Review. She clerked for Judge J. Skelly Wright of the United States Court of Appeals for the District of Columbia Circuit and served in the Carter administration as the general counsel of the Council on Wage and Price Stability in the Executive Office of the President.

Anthony Sanders

Anthony Sanders is the Director of the Center for Judicial Engagement (CJE) at the Institute for Justice and a senior attorney. He joined IJ in 2010. As CJE’s director, he educates the public about the proper role of judges in enforcing constitutional limits on the size and scope of government. As a senior attorney he litigates cutting-edge constitutional cases protecting economic liberty, private property, freedom of speech and other individual liberties in both federal and state courts across the country.

One area of Anthony’s expertise is on using state constitutions to protect individual rights. He is the author of the book, published by University of Michigan Press, Baby Ninth Amendments: How Americans Embraced Unenumerated Rights and Why It Matters. He has also written several law review articles on state constitutional law, unenumerated rights, judicial review, economic liberty, property rights, international law, and other subjects. His work has appeared in publications such as the Iowa Law Review, Minnesota Law Review, American University Law Review, and Rutgers Law Review, and he has published opinion pieces in leading media outlets across the country. Further, he frequently speaks to various audiences on these matters and others, including judicial engagement, free speech, civil forfeiture, and the continuing importance of Magna Carta. Additionally, he hosts the weekly Short Circuit podcast, which often records live in front of law student audiences.

Anthony has litigated several cases in various state courts on state constitutional protections, as well as in federal courts on matters such as economic liberty, free speech, administrative law, and fines and fees abuse. Prior to joining IJ, Anthony served as a law clerk to Justice W. William Leaphart on the Montana Supreme Court. Anthony also worked for several years in private practice in Chicago where he was an active member of the Chicago Bar Association and chaired its Civil Rights Committee.

Anthony received his law degree cum laude from the University of Minnesota Law School in 2004, where he served as an articles submission editor for the Minnesota Law Review. He received his undergraduate degree from Hamline University in St. Paul, Minnesota, and his master’s degree from the University of Wisconsin-Madison. A dual U.S. and U.K. citizen, Anthony grew up on the islands of Vashon in Washington State, and Alderney in the British Channel Islands.

Biography

Jonathan Urick is senior associate chief counsel at the U.S. Chamber Litigation Center, the litigation arm of the U.S. Chamber of Commerce. Urick handles a variety of litigation matters for the Chamber.

Urick rejoined the Chamber after helping launch the national litigation boutique Lehotsky Keller LLP, where he represented large corporations and trade associations as one of the firm’s early partners. He previously served as senior counsel for the Chamber Litigation Center, primarily covering arbitration and class-action issues.

Before his first stint at the Chamber, Urick practiced law at McGuireWoods LLP on the firm’s appeals and issues team. With a diverse commercial-litigation practice focused on appeals and dispositive motions, Urick represented a variety of businesses across federal and state courts.

Urick served as a law clerk at all three levels of the federal judiciary: For Justices Antonin Scalia and Clarence Thomas of the U.S. Supreme Court, Judge Jeffrey Sutton of the U.S. Court of Appeals for the Sixth Circuit, and Judge Amul Thapar, then a judge on the U.S. District Court for the Eastern District of Kentucky.

Urick graduated Order of the Coif from the University of Virginia School of Law, where he served as Articles Development Editor of the Virginia Law Review. He received his undergraduate degree in economics from the University of Delaware.
