He also served periodically on the National Security Council and the Homeland Security Council, and on the Committee on Foreign Investment in the United States.
Prior to his appointment to the Cabinet, Mr. Chertoff served from 2003 to 2005 on the U.S. Court of Appeals for the Third Circuit. Before becoming a federal judge, Mr. Chertoff was the Assistant Attorney General for the Criminal Division of the U.S. Department of Justice. In that position, he oversaw the investigation of the 9/11 terrorist attacks, and formed the Enron Task Force, which produced more than 20 convictions, including those of CEOs Jeffrey Skilling and Kenneth Lay.

From 2012-2014, Mr. Geiger served as Senior Legislative Counsel for U.S. Representative Zoe Lofgren of California. Joshua Kleinfeld teaches and writes about political, legal, and moral philosophy, criminal law, and criminal procedure. He also practices law in Northwestern's Juvenile Criminal Defense Clinic. He is a full professor with tenure at the Northwestern Pritzker School of the Law and (by courtesy) in Northwestern’s philosophy department. In 2017-18, he was a visiting professor at Harvard and Stanford Law Schools. He is the recipient of the Bator Award, given annually to one American law professor under the age of 40 who has demonstrated "excellence in legal scholarship, a commitment to teaching, a concern for students, and who has made a significant public impact."
In philosophy, Kleinfeld's research focuses on the idea of "embodied ethical life," as developed in the socio-theoretic tradition of Hegel, Weber, and Durkheim. This tradition aims to understand and critique social life by bringing to light the normative ideas implicit in social practices and institutions. In law, this means that the most interesting philosophical concepts are often those reflected or actualized in legal practice – in the law as judges and lawyers think of it and wield it.
In criminal law and procedure, Kleinfeld has developed a theory known as "reconstructivism," which holds that the chief office of criminal law is not to dole out retributive justice, nor to optimize crime and cost control, but to reconstruct a violated normative order in the wake of a crime. This work, which draws on the thought of Hegel, Durkheim, Jean Hampton, and Antony Duff, develops an alternative to retributive and utilitarian theories of criminal law by focusing on the distinctive social function and sense of justice at work in the criminal system.
Kleinfeld is also involved in practical criminal justice reform. In this vein, he defends children accused of homicide in the Northwestern Juvenile Criminal Defense clinic and assists in litigation efforts meant to reform American criminal law through the courts. He has also developed a view of criminal justice reform known as "democratization," which holds that the root of the American criminal justice crisis is a set of bureaucratic attitudes, structures, and incentives divorced from the American public’s concerns and sense of justice, and that the primary solution is to make criminal justice more community-focused and responsive to lay influences. Working with others, he has developed a number of policy proposals meant to reform American criminal justice in a democratic direction.
Kleinfeld holds a JD from Yale Law School, a PhD in philosophy from the Goethe University of Frankfurt (supervised by Axel Honneth, Klaus Günther, and Rainer Forst), and a BA in philosophy from Yale College. Joshua Kleinfeld teaches and writes about political, legal, and moral philosophy, criminal law, and criminal procedure. He also practices law in Northwestern's Juvenile Criminal Defense Clinic. In 2017-18, he was a visiting professor at Harvard and Stanford Law Schools. In philosophy, Kleinfeld's research focuses on the idea of "embodied ethical life," as developed in the socio-theoretic tradition of Hegel, Weber, and Durkheim. This tradition aims to understand and critique social life by bringing to light the normative ideas implicit in social practices and institutions. In law, this means that the most interesting philosophical concepts are often those reflected or actualized in legal practice – in the law as judges and lawyers think of it and wield it.
In criminal law and procedure, Kleinfeld has developed a theory known as "reconstructivism," which holds that the chief office of criminal law is not to dole out retributive justice, nor to optimize crime and cost control, but to reconstruct a violated normative order in the wake of a crime. This work, which draws on the thought of Hegel, Durkheim, Jean Hampton, and Antony Duff, develops an alternative to retributive and utilitarian theories of criminal law by focusing on the distinctive social function and sense of justice at work in the criminal system.
Kleinfeld is also involved in practical criminal justice reform. In this vein, he defends children accused of homicide in the Northwestern Juvenile Criminal Defense clinic and assists in litigation efforts meant to reform American criminal law through the courts. He has also developed a view of criminal justice reform known as "democratization," which holds that the root of the American criminal justice crisis is a set of bureaucratic attitudes, structures, and incentives divorced from the American public’s concerns and sense of justice, and that the primary solution is to make criminal justice more community-focused and responsive to lay influences. Working with others, he has developed a number of policy proposals meant to reform American criminal justice in a democratic direction.

Deputy Secretary of Transportation, US Department of Transportation
Steven G. Bradbury was sworn in as the Deputy Secretary of Transportation on March 13, 2025, following his confirmation by the U.S. Senate on March 11, 2025. In this role, he oversees the Department’s operating administrations and spearheads initiatives to ensure a safe, efficient, and modern transportation system that strengthens economic productivity and global competitiveness. Deputy Secretary Bradbury also assists Secretary Duffy in managing the Department’s activities, including its workforce of over 58,000 employees and an annual budget exceeding $109 billion.
Bradbury previously served as the 23rd General Counsel of the Department of Transportation from 2017 to 2021, as the Acting Deputy Secretary from 2019, and as Acting Secretary of Transportation in 2021. As General Counsel, he was the chief legal officer, advising on all legal matters and ensuring the integrity and compliance of the Department’s policies and programs.
Before rejoining DOT, Bradbury was a Distinguished Fellow at The Heritage Foundation from December 2022 to March 2025. Steven G. Bradbury was sworn in as the Deputy Secretary of Transportation on March 13, 2025, following his confirmation by the U.S. Senate on March 11, 2025. In this role, he oversees the Department’s operating administrations and spearheads initiatives to ensure a safe, efficient, and modern transportation system that strengthens economic productivity and global competitiveness. Deputy Secretary Bradbury also assists Secretary Duffy in managing the Department’s activities, including its workforce of over 58,000 employees and an annual budget exceeding $109 billion.
Bradbury previously served as the 23rd General Counsel of the Department of Transportation from 2017 to 2021, as the Acting Deputy Secretary from 2019, and as Acting Secretary of Transportation in 2021. As General Counsel, he was the chief legal officer, advising on all legal matters and ensuring the integrity and compliance of the Department’s policies and programs.
Before rejoining DOT, Bradbury was a Distinguished Fellow at The Heritage Foundation from December 2022 to March 2025. He has extensive experience in the public and private sector, having served as Principal Deputy and Acting Assistant Attorney General at the U.S. Department of Justice and as a partner at Kirkland & Ellis LLP and Dechert LLP. Earlier in his career, he clerked for Justice Clarence Thomas and Judge James L. Buckley.

Joel F. Brenner specializes in cyber and physical security, data protection, and privacy, intelligence law, and the regulation of sensitive cross-border transactions. He has represented companies and individuals in a wide variety of transactions and proceedings including sensitive foreign acquisitions and overseas operations, the liability of foreign governments, export controls, and internal corporate investigations. He has years of experience inside and outside government involving national and homeland security and enjoys working with companies of all sizes.
Mr. Brenner was Senior Counsel at the National Security Agency, advising Agency leadership on the public-private effort to create better security for the Internet. From 2006 until mid-2009, he was the head of U.S. counterintelligence under the Director of National Intelligence and was responsible for integrating the counterintelligence activities of the 17 departments and agencies with intelligence authorities, including the FBI and CIA and elements of the Departments of Defense, Energy, and Homeland Security. From 2002 – 2006, Mr. Brenner was NSA's Inspector General, responsible for that agency's top-secret internal audits and investigations. He has also served as a prosecutor in the Justice Department's Antitrust Division and has extensive trial and arbitration experience in private practice.
Mr. Brenner holds a JD from the Harvard Law School, a PhD from the London School of Economics, and a BA from the University of Wisconsin – Madison.
He is a member of the American Bar Association's Standing Committee on Law & National Security. He has written about intelligence oversight and Presidential authority to suspend or prohibit foreign takeovers of U.S. firms, and is often quoted in the national media on data security, privacy, and intelligence issues. Mr. Brenner was awarded the Intelligence Community Achievement Medal in July 2009.

Vince Vitkowsky chaired the Executive Committee of the Federalist Society’s International and National Security Law and Policy Practice Group for over a decade. He is also a Fellow at the National Security Institute of George Mason University Law School. Vince spent 45 years in private practice, primarily in AmLaw 100/200 firms and their spin-offs. His practice included domestic and international commercial arbitration and litigation, as well as cyber risks and liabilities. Vince's current focus is on national security policy, artificial intelligence, cybersecurity, and counterterrorism. John Yoo is the Emanuel Heller Professor of Law. He is also Distinguished Visiting Scholar, School of Civic Leadership and Senior Research Fellow, Civitas Institute, at the University of Texas at Austin. He is also a Nonresident Senior Fellow at the American Enterprise Institute.
His most recent book, The Politically Incorrect Guide to the Supreme Court, co-authored with Robert Delahunty, was published in 2023. Michael B. Mukasey is the former Attorney General of the United States, the nation’s chief law enforcement officer. As Attorney General from November 2007 to January 2009, he oversaw the U.S. Department of Justice and advised on critical issues of domestic and international law.
From 1988 to 2006, Judge Mukasey served as a district judge in the United States District Court for the Southern District of New York, becoming Chief Judge in 2000.
From 1972 to 1976, Judge Mukasey served as an Assistant United States Attorney for the Southern District of New York, and as Chief of the Official Corruption Unit from 1975 to 1976. His practice consisted of criminal litigation on behalf of the government, including investigation and prosecution of narcotics, bank robbery, interstate theft, securities fraud, fraud on the government and bribery. From 1976 to 1987 and from 2006 to 2007 he was in private practice.
Judge Mukasey has received numerous honors, including the Federal Bar Council’s Learned Hand Medal for Excellence in Federal Jurisprudence. He served as Chairman of the Committee on Public Access to Information and Proceedings of the New York Bar Association from 1984 to 1987. He served on the Federal Courts Committee of the Association of the Bar of the City of New York from 1979 to 1982 and its Communications Law Committee from 1983 to 1986.
