United States Supreme Court Term in Review

The death of Justice Antonin Scalia and the advent of the presidential election led to one of the longest periods in Supreme Court history with an open seat—the bulk of two Supreme Court Terms. Adding a further complication, the eight-member Court was seen as likely to be evenly divided on many high-profile cases and thus unable to resolve them. This prediction was based on the labels commonly applied to the Justices—four so-called “Liberals” and four so-called “Conservatives.” But the anticipated deadlock never developed; only a few cases resulted in a 4-4 tie. Several potential explanations for the Court’s ability to keep functioning warrant exploration, and on July 25, our distinguished panel will address that topic, the confirmation of Justice Neil Gorsuch, and selected decisions from the Term.
