John will be discussing with the Houston Laywers Chapter the trio of Title VII cases currently pending before the U.S. Supreme Court: R. G. & G.R. Harris Funeral Homes Inc v EEOC, Bostock v. Clayton County, and Altitude Express v. Zarda. The question in Harris is whether Title VII's prohibition on discrimination in employment because of "sex" includes gender identity; Bostock and Zarda rasie the same question involving sexual orientation. The answer to these questions turns on the original public meaning of the statute. How the U.S. Supreme Court responds will have substantial implication for originalism, public policy, and the rule of law.
