The State of the Washington Supreme Court: A 2008 Update

State Courts Project

The decisions of the Washington Supreme Court have provided an opportunity for reflection on how faithfully our judicial system reflects the allocation of power within our system of limited government.  In the two years since issuing a bitterly contested decision that rejected a demand for judicial imposition of same-sex marriage, the Washington Supreme Court has produced a mixed record in deciding cases that required the exercise of judicial restraint.  In some cases the court followed its constitutionally prescribed role.  But in others the court either shirked its responsibility to limit the power of the other branches of government, or else assumed the role of policymaker in the guise of statutory interpretation.  Come join us at the Discovery Institute for this timely discussion on the role of the Washington Supreme Court.
