The Second Amendment and the Future of Bruen

Please join the Cleveland Lawyers Chapter and Amy Swearer from the Heritage Foundation for an after-hours event as she leads a discussion on the upcoming cases of United States v. Rahimi and its impact on the Second Amendment. 

In New York State Rifle & Pistol Association v. Bruen, the Supreme Court affirmed that the Second Amendment protects a right to bear handguns in public for self-defense. Just as importantly, it upended the status quo of Second Amendment jurisprudence in the lower courts by clarifying, for the first time, that courts must use an analytical test based in text, history, and tradition alone. One year later, the Bruen test has made its way back to SCOTUS in United States v. Rahimi, where the Court must determine more precisely the limits of “reason by historical analogy.” How much of the nation’s pre-Bruen gun control framework remains intact when the legal fallout settles will depend largely on whether SCOTUS sticks to its guns in Rahimi, or uses Rahimi to pull back from Bruen.
