The FUCT Case of Trademarks and Free Speech: Registering Immoral and Scandalous Marks

Speakers:

  • Megan Carpenter - Dean, University of New Hampshire School of Law
  • Stacey Dogan - Associate Dean for Academic Affairs Law; Law Alumni Scholar, Boston University School of Law
Join the Boston Federalist Society Chapter on Thursday, May 9 at 5:00PM at McCarter and English for a discussion of the intersection of Trademark Law and Free Speech featuring two trademark experts, Dean Megan Carpenter of the University of New Hampshire and Associate Dean Stacey Dogan from Boston University.

Deans Carpenter and Dogan will discuss the purpose of the trademark system and the recent Supreme Court cases involving the Lanham Act’s registrability bar on disparaging, immoral or scandalous marks. The Supreme Court struck down the bar on disparaging marks on First Amendment grounds in a case involving The Slants, an Asian-American rock band, and granted certiorari to hear a pending case involving the mark FUCT for clothing.
What is the role of the government in policing the content of trademarks?

A reception with the speakers will follow. This is a free event.

Space is limited so please RSVP online.
