The Environmental Protection Agency's recently adopted Clean Power Plan rule takes the cake for a seizure of federal power beyond the bounds of statute and constitutional principle.  Executive and independent agencies operate increasingly as a fourth branch of government, beyond the effective control of the President, Congress and the federal courts.  But as Laurence Tribe noted in the Wall Street Journal last December: “Frustration with congressional inaction cannot justify throwing the Constitution overboard to rescue this lawless EPA proposal.”  Come hear how the U.S. Congress, state legislatures, and state agencies can rein in the EPA’s administrative excess.
