Should Ohio Adopt Merit Selection? An Analysis of Lessons From Missouri and Tennessee

Over the past year, calls from within the organized bar, members of Ohio's judiciary, and interest groups have grown for Ohio to abandon the election of judges and to adopt a "merit" selection system. Under the merit selection system, a judicial selections commission would, subject to varying degrees of control by the Governor and General Assembly, select all of Ohio's judges. Missouri and Tennessee have recently eliminated the election of judges and have adopted a merit selection system. Professor Fitzpatrick has studied the impact of merit selection on the distribution of ideological and decisional propensities of judges in those states before and after the implementation of merit selection, and will discuss his thought provoking conclusions and their impact on how merit selection might impact the quality and impartiality of Ohio's judicial system.
