California's recent same-sex marriage controversy has highlighted the growing clash between religious liberties and gay rights issues. As more courts recognize gay rights as civil rights, entitled to protection under the Equal Protection clause, there is growing concern that courts may curtail religious liberties in order to vindicate those civil rights. Some cases have held that employees may be fired for expressing faith-based opposition to homosexuality; many have expressed concern that ministers may be forced to officiate same-sex weddings over religious objections, or that social workers may be forced to place adoptions for gay couples. Professor Dent will examine these issues in light of the recent case law and will examine ways in which a balance can be struck between the civil rights of homosexuals and the civil rights of religious peoples.
