At a press conference last week, President Obama indicated support for reforms of the Foreign Intelligence Surveillance Court. The President’s Review Group on Intelligence and Communications Technologies and members of Congress have made various reform proposals. These include the manner in which FISC member judges are appointed, allowing public interest advocates to participate in certain cases to ensure decisions are reached through an adversarial process, allowing the filing of amicus briefs by interested parties in certain cases, and increasing transparency of the court. Our experts will discuss whether or not reform is advisable, and the proposals being considered.
