Race, Rawls and the Supreme Court: Does Rawls Explain the Opinions of the Court's Right?

Philosopher John Rawls' theory of justice is a foundation of American liberal thinking. In spite of that, Professor Carcieri contends that justices on the Supreme Court's right are truer to Rawls' theory in race cases than justices on the left. Analyzing opinions in UC Regents v. Bakke, Grutter v. Bollinger, and PICS v. Seattle School District No. 1, Professor Carcieri argues that the Court's right is true to Rawls' core principles of equal basic liberty and fair equality of opportunity for each person in its race and public education cases.
