There are a number of active cases in Arizona challenging the constitutionality of reforms to public pension programs. One of these cases, Fields v. Elected Official Retirement Plan of the State of Arizona, (Fields v. EORP) is pending before our Supreme Court. Nationwide, in a number of instances where state and local governments have adopted pension reforms, or where public pensions will be affected by municipal bankruptcies, similar lawsuits have been instituted. Although there are a great number of active cases across the country, there is a dearth of scholarly treatment of the legal and constitutional issues surrounding pension reform. Please join us for a discussion of these issues in Arizona and nationwide.
