The Obama Administration has repeatedly relied on executive discretion in declining to enforce Federal statutes. From declining to enforce vast portions of immigration law to selectively waiving multiple portions of the Obamacare statute, fair questions have been raised on whether the president is faithfully executing the laws. Is the Administration simply engaged in an aggressive form of prosecutorial discretion, or does its approach threaten the rule of law?
Professor Robert J. Delahunty will address the question. With more than a decade of experience with the Office of Legal Counsel, his work as "counsel to the presidency" informs his discussion of this important topic.
