Tucked away in the massive Dodd-Frank legislation is a single amendment that regulates the amounts that banks can collect for debit interchange. The provision is now under constitutional attack as a confiscatory taking. Professor Epstein is part of the litigation team that is taking on the Amendment. His talk will reflect on what he has learned about the ways in which statutes are made, enforced, and challenged.
